RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock, Change Order #2 on the
Milwaukee Avenue from 34`x' Street to 92"d Street Paving Improvement Construction
Contract with Granite Construction Company. Change Order is attached hereto and
incorporated in this Resolution as if fully set forth herein and shall be included in the
minutes of the Council.

Project Name. Milwaukee Avenue Paving Impeovements -

Change Order within the scope of the contract means a Change Order that DOES NOT ALTER THE NATURE OF THE THING
TO BE CONSTRUCTED AND THAT IS AN INTEGRAL PART OF THE PROJECT OBJECTIVE. After performance of a
construction contract begins, Change Orders may be approved if necessary to 1) make changes in plans or specifications; or 2)
decrease or increase the quantity of work to be performed or materials, equipment, or supplies to be furnished. This DOES NOT
mean that a department can redefine the project. All work that alters the „nature . of the thing to be constructed or that is not an
integral part of the proiect obiective must be let out for public bid by the Purchasing Department. Description of change
(alteration, deviation, addition, or deletion) caused by conditions encountered during construction not covered by the
specifications and drawings of the project attach additional es if necessary):
Continue the Trench Backfill Remediation work from the southern limit of work in the existing contract. This work would
include excavating and recompacting the sewer trench from approximately 92nd Street to 98" Street, then to the east along
98c' street to Juneau Avenue (see attached map and profile). This adds approximately 4492 LF of length and 36,700 CY of
additional bid quantity for item #79 - Trench Backfill Remediation at a unit cost of $11 per cubic yard ($403,700). This
work will require adding an additional month of traffic control at a rate of $12,500/mo for a total of $416,200.
Change Orders must either be negotiated in the best interest of the City of Lubbock or put out for public bid by the Purchasing
Department. Where the Change Order is negotiated, the Change Order must be fully documented and itemized as to costs,
including material quantities, material costs, taxes, insurance, employee benefits, other related costs, profit and overhead. Where
certain unit prices are contained in the initial contract, no deviations are allowed in computing negotiated change order costs.
ITEMIZED COSTS MUST BE FULLY DOCUMENTED AND ATTACHED TO THIS FORM.

in anyway incident to, or arising out of or resulting directly or indirectly; from the work performed or modified by the Contractor
under this Change Order.

The owner would like for Granite to consider continuing the Trench Backfill Remediation work from the southern limit
of work in the existing contract This work would include remediating the sewer trench from approximately 92nd Street

Attached is a profile of approximate natural ground, limits of remediation and limit of bench in relation to one another.

As requested by Sean Cudnoski on PSC RFI -04 dated July 29, 2005, Granite
Construction will perform the additional Trench Remediation from station 115+00 to
approximate station 72+50 at the original bid price. We request that 1 month of traffic
control be added to the change order for the traffic control work indicated.
It is our understanding that this work will not be subject to the April 1, 2006 substantial
complete deadline.

ATTACHMENT TO CHANGE ORDER NO. 2
CONTRACT TIME CHANGES
The contract time is extended 120 calendar days by this Change Order No. 2.
However, all work except that work defined by this Change Order No. 2 shall be
completed within the times and dates, whether defined as milestones or completion dates,
as established by the original agreement. The additional 120 calendar days defined by
this document shall be for Change Order No. 2 work only.
