Said Amendment is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. Subrecipient: City of Lubbock I Citibus ' 6487 State Project No: ED 0584(05) 6 4 8 7 PTN Grant Agreement No.: 050V71VT R S"! sos x`7/93 G� STATE/LOCAL PUBLIC TRANSPORTATION GRANT AGREEMENT AMENDMENT # 1 THIS AMENDMENT IS MADE BY AND BETWEEN the State of Texas, acting through the Texas Department of Transportation, hereinafter called the "State", and City of Lubbock! Citibus, hereinafter called the "Subrecipient ITiTI�i`l�"y4>y. WHEREAS, the State and the Subrecipient executed a contract on May 1 of 2805 to effectuate their agreement to provide for the expenditure of funds pursuant to the provisions of 49 U.S.C., 5310, for providing mass transportation services to Elderly individuals with disabilities; and, WHEREAS, it has become necessary to amend that grant agreement; NOW THEREFORE, in consideration of the premises and of the mutual covenants and agreements of the parties hereto, the State and the Subrecipient do agree as follows: AGREEMENT Article 1. Description of Amended Items The Federal Transit Administration has made available the final allocation of funds for the FY 2005 Fiscal Year grant. The Department has allocated these funds effective with this amendment. Therefore, Article 3A, page 2, sentence 1 is revised to read "The maximum amount payable under this agreement without modification is $31,943.00". Attached hereto is the revised project budget and shall replace the budget included with the above-mentioned Grant. Article 1 is revised to read "This grant amendment shall terminate on August 31, 2006, unless terminated or otherwise modified as hereinafter provided". All other provisions of the original grant agreement are unchanged and remain in full force and effect. Article 2. Signatory Warranty The signatories to this amendment warrant that each has the authority to enter into this agreement on behalf of the organization they represent. IN WITNESS WHEREOF, THE STATE AND THE SUBRECIPIENT have executed duplicate counterparts to effectuate this agreement.
