RESOLUTION
WHEREAS, Lubbock -Cooper Independent School District ("LCISD") is a school
district located in part within the municipal boundaries of the City of Lubbock, Texas;
WHEREAS, a certain school campus of LCISD is located within the City of
Lubbock, namely Cooper North Elementary, and is currently a retail water customer of
the City of Lubbock;
WHEREAS, LCISD plans additional campus construction within the City of
Lubbock in the future, such additional campuses also to be retail water customers of the
City of Lubbock;
WHEREAS, citizens of the City of Lubbock attend LCISD at the campus located
outside of the City of Lubbock, in or around the community of Woodrow, Texas (the
"Woodrow Campus");
WHEREAS, LCISD is considering the expansion of its Woodrow Campus and is
contemplating a bond election in May 2006 for such expansion;
WHEREAS, a part of such bond issue to be decided by the voters would be to
obtain funds to construct pipelines and other improvements related to waterworks for the
Woodrow Campus;
WHEREAS, due to such expansion, LCISD is investigating alternative sources of
water for the Woodrow Campus;
WHEREAS, Section 28-59(f) of the Code of Ordinances of the City of Lubbock
permits the City of Lubbock to sell water to federal, state or local governments,
governmental agencies or governmental subdivisions pursuant to appropriate
intergovernmental contracts;
WHEREAS, so that LCISD may prepare proper plans for its future expansion
activities, LCISD has requested the City Council of the City of Lubbock to agree in
principle to the sale of wholesale water to LCISD for its use, and only for its use, at the
Woodrow Campus; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the City of Lubbock agrees in principle to the wholesale sale
of water to LCISD for LCISD's, and only LCISD's, use at the Woodrow Campus. This
agreement in principle is subject to the City of Lubbock and LCISD entering into a
definitive sales contract as described below.
SECTION 2. THAT the City Manager of the City of Lubbock enter into
negotiations with LCISD to provide for such wholesale sale of water and, in the event an
agreement be reached, to present to the City Council of the City of Lubbock in the fixture
a definitive intergovernmental contract for such sale. Such contract shall contain all
terms regarding the wholesale sale of water to LCISD as may be mutually agreed upon by
LCISD and the City of Lubbock.
