AN ORDINANCE DECLARING IT TO BE UNLAWFUL FOR ANY
PERSON OR PERSONS IN CHARGE OF OR OPERATING A MOTOR VEHICLE
TO ALLOW, PERMIT, OR TO PARK THE SAID MOTOR VEHICLE HABIT
UALLY ON THE STREET ABUTTING RESIDENTIAL PROPERTY WHEN THE
OPERATOR OF THE SAID MOTOR VEHICLE DOES NOT OWN NOR OCCUPY
THE RESIDENCE OR A PORTION OF THE LOT; PROVIDING FOR IMPOUND
ING OF THE SAID MOTOR VEHICLE BY THE CHIEF OF POLICE AND
ISSUING NOTICE TO APPEAR; PROVIDING PENALTY FOR VIOLATION;
AND DIRECTING THE CITY SECRETARY TO PUBLISH CAPTION AND
PENALTY CLAUSE AS AN ALTERNATIVE PROVIDED BY LAW.
WHEREAS, certain persons living in residential areas of the City of
Lubbock, Texas, are having the front of their residences blocked day and
night by motor vehicles parked in front of their homes on the street, and,
WHEREAS, the same operator and owner of the motor vehicles are
parking the said vehicle in front of the residence over several days 1 period
without moving the said vehicle and thereby preventing the occupants from
enjoying the full use and benefits of the premises, THEREFORE,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. THAT it shall hereafter be unlawful for any person or
persons in charge of or operating a motor vehicle to allow, permit, or to
park the said motor vehicle habitually on that portion of the street abutting
residential property when the operator of the said motor vehicle does not own
nor occupy the residence or a portion of the lot.
SECTION 2. Upon notification of the Chief of Police by the owner or
occupant of the premises abutting that portion of the street where the motor
vehicle is permitted to stand that the said motor vehicle has been habitually
parked in front of the premises, and after the person complaining of the viola
tion has filed a sworn oomplaint with the Corporation Court of the City of
Lubbock, the Chief of Police shall have the said motor vehicle impounded in
the City Motor Vehicle Pound or garage used by the City for impounding
motor vehicles, and direct that the operator of the said motor vehicle be
issued a Notice to Appear or a copy thereof showing the violation.
SECTION 3. Any person violating this ordinance shall, upon con·
viction, be guilty of a misdemeanor and shall be fined in any sum not to exceed
Two Hundred Dollars ($200. 00).
SECTION 4. The City Secretary is hereby directed to cause publica
tion of the descriptive caption of this ordinance, together with the penalty
clause {Section 3), as an alterna;tive provided by law.
