AN ORDINANCE REDUCING THE BUILDING SET-BACK LINE ON THE
NOR. TH PART OF Z3D STREET BETWEEN AVENUE. J AND AVENUE H SO AS
TO RE-ESTABLISH THE BUILDING LlNE ON THE NORTH SIDE TO CONFORM
TO THE BUILDING LINE HERETOFORE ESTABLISHED BY THE LAWFUL
CONSTRUCTION OF EXPENSIVE BUILD;INGS -AND STRUCTURES. AND
REPEALING THAT PART OF EXISTING CONFLICTING PROVISIONS.
WHEREAS, for many years, and prior to the passage of an amend:nent
to the Zoning Ordinance relating to set-back lines, the street known as Z3d
Street between Avenue J and Avenue H, and the block east of Avenue H, several
buildings were constructed upon the then existing property line allowing for a
street fifty (50) feet in width between said property lines, and to require con
templated improvements upon a~ing property to set back beyond existing
property lines would be inequitable 'to owners of vacant abutting property due
to the existence of buildings constructed which, if required, would produce an
abnorma~, irregular set-back line; and the City Commission finds that by
reducing the set-back line on the North side of Z3d Street between Avenue Hand
Avenue J ·from a distance of thirty-seven and one-hall (37-1/Z) feet from the
centerline o f the existing paved s t reet to a distance of twenty-five (Z5) feet,
affected property owners would not be discriminated against, and that the
street as it now exists is adequate to meet public needs for street purposes
within the reasonably foreseeable future, THEREFORE,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. THAT the building set-back line on the North side of 23d
Street between Avenue Hand Avenue J is hereby modified and re-established
to coincide with the North property line of Z3d Street between Avenue Hand
Avenue J, he same being twenty-five (ZS) feet North of the centerline of said
street.
SECTION z. That part of every ordinance in conflict with the provisions
of Section 1 of this ordinance is hereby repealed, but the provisions d this
ordinance shall never be construed in any manner to modify or otherwise affect
the provisions of existing ordinances as they relate to other wilding lines.
AND IT IS SO ORDERED.
Passed and approved on first reading by unanimous vote of the City Com
mission this 28th day of June, 1951 •
