ORDINANCE NO. 1108 AN ORDINANCE ANNEXING ALL OF "HULIN HEIGHTS ADDITION" AND THE "SECOND INSTALLMENT TO HULIN HEIGHTS ADDITION, " INCLUDED WITHIN THE METES AND BOUNDS DESCRIPTION DESIGNATED IN THE BODY OF THIS ORDINANCE; PROVIDING FOR PUBLICATION AND FINAL PASSAGE UNDER THE PROVISIONS OF SECTION 3A, ARTICLE I, CHAPTER I, OF THE CHARTER OF THE CITY OF LUBBOCK, I(LND EXTENDING THE CORPORATE LIMITS OF THE CITY OF LUBBOCK TO INCLUDE SAID AREAS. WHEREAS, the City Commission has been urged by petition of the owners of the tract hereinafter described to annex and include said areas within the cor- porate limits of the City, and the City Commission finds that said areas are in line of development, growth, and expansion:being experienced by the City, that annexation of said areas to the City of Lubbock will be in the public interest, and the City Commission is authorized to annex said areas which are adjacent to and abut the corporate limits of the city of Lubbock, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1: THAT the following described area, which includes "Hulin Heights Addition" and the'"Second (2d) Installment to Hulin Heights Addition, " and described by metes and bounds as follows, to -wit: BEGINNING at a point on the existing City Limit Line, which point is Z640 feet South of and 2640 feet East of the Northwest corner of Section Fourteen (14), Block B, this point being in the intersection of 42d Street and Elgin Avenue; THENCE South along the center line of Elgin Avenue, the existing City Limit Line and the half - section line 1345 feet to a point in the South line of 46th Street; THENCE West along the South line of 46th Street 13ZO feet to the intersection of the South line of 46th Street and the center line of Gary Avenue; THENCE North along the center line d Gary Avenue 1345 feet to a point in the intersection of 42d Street and Gary r Avenue; THENCE East 1320 feet along the existing City Limit Line in 4Zd Street to the POINT OF BEGINNING. BE, and the same is hereby annexed to and included within the corporate limits of the City of Lubbock. SECTION 2; This Ordinance shall be published in a daily newspaper, published in the City of Lubbock, Texas, one time, and shall not thereafter be finally acted upon until at least thirty (30) days have elapsed after such publica- tion, and if finally passed in its present form, the boundary limits of the City of Lubbock, Texas, shall hereafter be fixed and extended to include the extensions described in Section 1 of this Ordinance. AND IT IS SO ORDERED. On motion of Commissioner L. E. Davis , seconded by Commissioner �a�rxY�ie , and unanimously carried by an affirmative vote of each member of the City Commission of the City of Lubbock, this Ordinance was ordered to be published at a regular meeting of the City Commission, this 12th day of July, 1951. We agree that if this property is developed and paving or other utilities are required, that the owner or owners will deposit the entire cost of all water _f• and sewer extensions needed to serve the area, and will grade, drain and pave at our expense all streets within the subdivision. We further agree to pay the pro- rata charges of $1.20 per front foot of property within the area served for water service, and 800 per front foot for sewer service into the streets and alleys, it being understood that the City will refund that portion of f1total cost", as de- fined by ordinance, over and above the pro rata charge next above stated, such refund to be made on the regular five-year water and sewer line extension policy now in effect within the corporate limits. Also that no vested rights shall be acquired by us by reason of such annexation, and all paving, water and sewer lines placed in the streets and alleys by us or other persons are hereby dedicated to public use and shall be the property of the City of Lubbock. We further agree that pavement will be constructed in accordance with the plans and specifications either prepared or approved by the Engineering Department of the City of Lubbock, and to construct water and sewer lines as required by any ordinance, rule or regulation of the City of Lubbock, and that all sub -surface utility lines will be completed prior to the construction of any pavement in the area.
