WHEREAS, the First Methodist Church of Lubbock, Texas, is the ~wner of all _of Block 129, Origi~l Town of Lubbock, Lubbock County, Texas~ and, WHEREAS, there is an alley running North and South from 13th Street to an alley running East and West through said Block, and, whereas, the City of Lubbock has been requested to close said alley running North and South through the South Half of said Block 129, Original Town of Lubbock, Lubbock County, Texas; and, WHEREAS, it has been determined by the City Commission that said alley running North and South through the South Half of said Block 129, Original Town of Lubbock, Lubbock County, Texas, should be closed subject to certain reservations, exceptions and conditions hereinafter set forth. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1: The alley running North and South through Block 129, Ori~inal Town of Lubbock, Lubbock County, Texas, from 13th Street to an alley running East and West, through said Block 129, be and the same is hereby closed, so long as the F1rst Methodist Church of Lubbock, Texas, uses said Block 129, Original Town of Lubbock, Lubbock County, Texas, for church purposes, and in the event the First Methodist Church or Lubbock, Texas, ceases to use said property tor church pur- poses, then said alley shall automatically be reopened for the use of the public. SECTION II: The City of Lubbock expressly excepts and reserves to itself a perpetual easement in, over and under the alley referred to and closed in Section 1 hereof, the easements and rights reserved being for the installation of public utilities, such as gas lines, water lines, sewerage \ lines, electric light lines, telegraph lines and telephone lines. SECTION III: The closing of the alley as provided in section 1 of this ordinance is conditioned that the First Methodist ~hurch of Lubbock, Texas, will pay all costs tor moving, relocating, and pro p erly protecting all public utility lines located and situated in the north and south Alley in Block 129, Original Town of Lubbock, Lubbock County, Texas, AND IT IS so ORDERED. PASSED and approved first reading this the 8th day of February , A.D. 1945. PASSED AND APPROVED second reading this the 22nd day of February , A.D. 1945.
