HomeMy WebLinkAboutResolution - 2006-R0571 - Release Extraterritorial Juisdiction - New Deal - 323 Acres - 12/07/2006Resolution No. 2006—R0571 December 7, 2006 Item No. 5.1 RESOLUTION WHEREAS, the City of New Deal, Texas, has requested that the City of Lubbock release extraterritorial jurisdiction authority for an area of some 323 acres located in the City of Lubbock's extraterritorial jurisdiction (ETJ) south of the City of New Deal as shown in the aerial map attached hereto as Exhibit 1 and further described in the metes and bounds description attached as Exhibit 2; and WHEREAS, the City of New Deal, Texas, in 1996, after notification of the City of Lubbock, annexed an arca of some 103 acres located in the City of Lubbock's ETJ into the City of New Deal (Area B shown in Exhibit 1); and WHEREAS, Section 42.023 of the Local Government Code requires written consent to annexation by a municipality whose extraterritorial jurisdiction is reduced by an annexation conducted by another municipality; and WHEREAS, the City of Lubbock does not object to future annexation by the City of New Deal of Areas A and C shown in Exhibit 1 and desires to formally ratify consent of the 1996 annexation; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: Ti [AT the governing body of the City of Lubbock hereby gives written consent to release extraterritorial juri.�diction to the City of New Deal for the 323 acres shown in the aerial map attached as Exhibit I and further described by metes and bounds in Exhibit 2, both of which are incorporated herein as if fully set forth and made a part hereof for all purposes.
