HomeMy WebLinkAboutResolution - 2007-R0526 - Amendment To Lease Agreement - Abilene Aero Inc.- LPSIA Change Term For Hangar - 11/08/2007Resolution No. 2007-RO526 November 8, 2007 Item No. 5.11 RESOLUTION IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock Amendment #2 to the Lease Agreement with Abilene Aero, Inc. d/b/a Lubbock Aero, amending their lease at the Lubbock Preston Smith International Airport by changing the term in the agreement for the Brick Hangar Building and associated land. Said Amendment is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. Chamales, Senior Attorney Office Practice Section LC: UATTY[Linda/RES-Lubbock Aero AMENDMENT #2 August 30, 2007 Resolution No. 2007-RO526 STATE OF TEXAS § KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LUBBOCK AMENDMENT #2 TO LEASE AGREEMENT This Agreement is entered into by the CITY OF LUBBOCK (referred to herein as "Lessor"), a Home Rule Municipality of Lubbock County, Texas, and ABILENE AERO, INC. d/b/a LUBBOCK AERO (referred to herein as "Lessee"). WITNESSETH: WHEREAS, Lessor and Lessee executed a Lease Agreement on the 9'h day of May, 2002, in which Lessee was granted the privilege of operating as a Fixed Base Operator under L Multiple Services in the Minimum Standards for Aeronautical Activities, 1991 as may be amended from time to time; and WHEREAS, Lessee desires to lease Hangar 20 under a separate lease agreement; WHEREAS, Lessee desires to amend the May 9d' agreement by changing the term expiration date for the Brick Hangar Building and the associated land in the agreement; NOW THEREFORE, Lessor and Lessee agree as follows: I. Article Two, 2.01 Term, is amended by adding: "The term for the Lessor -owned Brick Hangar Building (13,440 square feet) and associated Land for the Brick Hangar Building (20,800 square feet) shall be on a month-to-month basis." Article Seven, 7.01 Termination, is amended by adding: "The Lessor or the Lessee shall terminate the lease of the Lessor -owned Brick Hangar Building and the associated land by giving ten (10) days advance written notice." Article Eight, Miscellaneous Provisions is amended by adding Section 8:03: "8.03 LESSOR -OWNED BRICK HANGAR It is the intent of the Lessor to demolish the existing 13,440 square foot brick hangar building when and if funds become available for that purpose.
