HomeMy WebLinkAboutResolution - 2007-R0431 - Extend Water Main Into Subject Property - 09/13/2007Resolution No. 2007-RO431 September 13, 2007 Item No. 5.22 RESOLUTION WHEREAS, that certain real property described on Exhibit "A", attached hereto, (the "Subject Property"), is located within the municipal boundaries of the City of Lubbock; WHEREAS, the Subject Property is not presently served by water service by the City of Lubbock and has no other potable source of water available to it; WHEREAS, the City of Lubbock Code of Ordinances, Section 28-163, provides that in instances, and upon City Council findings, as provided therein, the City may extend water mains into certain areas without a deposit for such extension being required from the property owner. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the City Council of the City of Lubbock finds that the Subject Property is in a densely populated area that, due to the absence of water service, the public welfare would best be served by making water extension at its own cost, and after due investigation and consideration, in order to avoid and eliminate extremely unhealthful conditions which are contributing factors to epidemics, and that money is presently available for such purpose. BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT, due to the findings set forth immediately above, the City Council resolves that the City shall extend a water main into the area of the Subject Property, as depicted on Exhibit "B"; however, that when such line is extended following this Resolution, the owner of the Subject Property shall be required to pay the pro rata charges established by Chapter 28 of the Code of Ordinances of the City of Lubbock when such property is connected to the water main.
