HomeMy WebLinkAboutResolution - 2007-R0350 - Termination Agreement - X-Fab Texas - Tax Abatement Agreement - 07/26/2007Resolutlon No. 20078350 July 26, 2007 Item No. 6.11 RESOLUTION IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and irected to execute for and on behalf of the City of Lubbock a Termination Agreement in -FAB X -FAB Texas terminating the Tax Abatement Agreement dated February 24, 2000 and amended April 27, 2000, and all related documents. Said Termination Agreement is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. by the City Council this 26th day of July , 2007• DAVID A. Chamales, Senior Attorney Practice Section cityatt f Linda / Res -Tax Abatement 'termination X -Fab 13, 2007 Resolution No. 2007-RO350 STATE OF TEXAS § KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LUBBOCK § TERMINATION AGREEMENT This Agreement is entered into by the CITY OF LUBBOCK (referred to herein as "City"), a Home Rule Municipality of Lubbock County, Texas, and X -FAB Texas (referred to herein as "Company") WITNESSETH; WHEREAS, City executed a Tax Abatement Agreement with Company on February 24, 2000, which was amended on April 27, 2000, granting a ten year declining scale tax abatement on the property described in Exhibit A; and WHEREAS, Section 312.208(b) of the Texas Tax Code allows for termination of the Tax Abatement Agreement by the mutual consent of the parties; and WHEREAS, City and Company each desire to terminate this Agreement; NOW THEREFORE, City and Company agree as follows: The Tax Abatement Agreement between the City of Lubbock and X -FAB Texas approved February 24, 2000 by Resolution No. 2000-R0058, which was amended April 27, 2000, by Resolution No. 2000 -ROI 15, is hereby terminated. A description of the property which was the subject of the tax abatement is attached as Exhibit A and is incorporated herein as if fully set forth. MEINKO H, PRESIDENT ATTEST: Secretary Termination Agreement — X -FAB Tax Abatement Page 2 Resolution No. 2007-RO350 Exhibit "A" SITUATED in the City of Lubbock and being all of Tract A, Texas Instruments Addition, an addition to the City of Lubbock according to the map, plat and/or dedication deed thereof, recorded in Volume 1363, Page 977, Deed Records of Lubbock County, Texas (D.R.L.C.T.) and all of that abandoned Drake Street as described by Correction Quit Claim Deed from the City of Lubbock to Texas Instruments Incorporated, a Delaware corporation, recorded in Volume 1541, Page 32, D.R.L.C.T. and being more particularly described by metes and bounds as follows: BEGINNING at an aluminum disk monument found at the Northeast corner of said Drake Street on the South line of Block 1, Lubbock State School Addition, an addition to the City of Lubbock, according to the map, plat and/or dedication deed thereof, recorded in Volume 1143,Page 677, D.R.L.C.T. and also being North 0 deg. 01 min. 09 see.
