RESOLUTION
IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
;ted to execute for and on behalf of the City of Lubbock an Interlocal Agreement with
Lubbock Housing Authority regarding waiver of city landfill disposal fees for
olition materials. Said Interlocal Agreement is attached hereto and incorporated in
Resolution as if fully set forth herein and shall be included in the minutes of the
ncil.

INTERLOCAL COOPERATION
AGREEMENT
COUNTY OF LUBBOCK §
THIS INTERLOCAL AGREEMENT ("Agreement") is made and entered into
pursuant to the Interlocal Cooperation Act (Chapter 791, Government Code) by
and between the City of LUBBOCK, TEXAS hereinafter referred to as
"LUBBOCK" and the LUBBOCK HOUSING AUTHORITY, hereinafter referred
to as "LHA."
WHEREAS, LHA is a not-for-profit public body corporate and politic created
under Texas Local Government Code Chapter 392; and LUBBOCK is a home
rule municipal corporation operating under the charter of the municipality; and
WHEREAS, LUBBOCK and LHA mutually desire to cooperate in providing
quality affordable housing in Lubbock; and
WHEREAS, LHA has participated in building two new apartment communities
in East Lubbock over the past three years and has applied for and been awarded
tax credit funds to build another similar development; and
"WHEREAS, the current project will enable LHA to demolish its Green -Fair
Manor development, a blighted and antiquated public housing complex in East
Lubbock, and to replace that complex with a new 120 unit apartment community;
and
WHEREAS, LHA has requested a waiver of the disposal fees at the city landfill
for the disposal of debris resulting from the demolition of the current Green -Fair
Manor Development; and
WHEREAS, the City Council of the City of Lubbock finds that this planned
development is consistent with the City of Lubbock's Consolidated Plan to
eliminate blighted and dilapidated housing in the City, especially in North and
East Lubbock; and
WHEREAS, the City Council further finds that completion of the project will
vastly improve one of the older neighborhoods in our city and will provide much
needed housing that will be safe and affordable; NOW
THEREFORE, the following agreement is entered by and between LUBBOCK
and RALLS as follows:
LHA shall participate in the demolishing of Green -Fair Manor Development and
in building a replacement complex with a new 12.0 unit apartment community
similar to Park Meadows Phase I.
INTERLOCAL AGREEMENT - LUBBOCK / LHA
LUBBOCK shall waive the disposal fees at the city landfill for the disposal of
debris resulting from the demolition of the current Green -Fair Manor
Development.
Any payments for services that arise or may arise out of the performance of this
Agreement shall be made from the current revenues available to the paying party.
To the extent authorized by law, the LUBBOCK and LHA shall each hold the
other harmless from any claim or damages of any nature whatsoever arising from
the acts of its own officials and employees in connection with this agreement.
Either party may terminate this agreement upon thirty (30) days written notice to
the other.
IN WITNESS WHEREOF, the parties to this Agreement have executed this
Agreement as of the effective date written below, each respective party acting by
and through its governing body or its designee in the manner required by each
party's charter or otherwise required by law on the date herein below specified.
