RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the City Council of the City of Lubbock hereby authorizes and directs the
Mayor of the City of Lubbock to execute an Advertising Services Contract by and
between the City of Lubbock and The Thomas Agency of Lubbock, Texas, for full service
advertising and marketing services for the City of Lubbock per RFP 07 -015 -RW, which
Contract and any associated documents are attached hereto and made a part of this
Resolution for all intents and purposes.
Passed by the City Council this 26th day of April , 2007.

Advertising Services Contract
The Thomas Agency
The City of Lubbock
THIS CONTRACT is made this 26th day of April , 2007, by and between The
City of Lubbock, hereinafter designated "Advertiser," and The Thomas Agency, an advertising
and design firm.
Term:
The Term of this contract shall be for five months beginning May 14, 2007, with an
automatic extension for two (2) years.
Scope of Service:
This contract is for the Thomas Agency to provide full-service advertising & marketing
services for the Advertiser. These services include a variety of media campaigns, print
publications and video presentations for various City departments. The Thomas Agency will
advise on content and design of material; prepare the advertising/marketing product; select the
appropriate media for advertising; place the buy; and handle the billing as set forth by the
Advertiser in City of Lubbock RFP #07 -015 -RW, which shall be attached hereto as Exhibit A
and made a part of this contract for all intents and purposes. To the extent of any conflict, this
contract shall control.
Compensation:
Advertiser shall pay the Thomas Agency an hourly rate of Fifty and no/100 Dollars (S50)
for these services, excluding translation services for which Advertiser shall pay an hourly rate of
Twenty-five and no/100 dollars ($25), and will reimburse The Thomas Agency the gross
invoiced amount for media buys. In addition, The Thomas Agency shall receive the standard
agency 15% commission on all placed media, printing and production.
Billing and responsibility for such advertising shall be billed to Advertiser in care of The
Thomas Agency (Advertiser shall continue to be responsible for payment). The Thomas Agency
shall insure that such billings are transmitted to the Advertiser promptly upon receipt.
Insurance Coverage:
The Thomas Agency shall obtain and maintain in full force and effect for the duration of this
contract, and any extension hereof, at The Thomas Agency's sole expense, insurance coverage
written by companies, approved by the State of Texas and acceptable to the City, in the
following type(s) and amount(s):

ADDITIONAL POLICY ENDORSEMENTS: The City shall be entitled, upon request, and
without expense, to receive copies of the policies and all endorsements thereto and may make
any reasonable request for deletion, revision, or modification of particular policy terms,
conditions, limitations, or exclusions (except where policy provisions are established by law or
regulation binding upon either of the parties hereto or the underwriter of any of such policies).
Upon such request by the City, The Thomas Agency shall exercise reasonable efforts to
accomplish such changes in policy coverages, and shall pay the cost thereof.
Indemnity
Each party to this contract hereby agrees to hold the other harmless from any claims of
any nature whatsoever arising out of the activities of its own employees, officers or agents
pursuant to this contract.
Acceptance
Acceptance of the terms set forth in this contract are hereby acknowledged by signing
below.
