Resolution No. 2007—RO160 April 12, 2007 Item No. 6.6 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock, a Contract for ISO consulting services, by and between the City of Lubbock and Mike Pietsch, P.E, Consulting Services, Inc, and related documents. Said Contract is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. Consulting Services, Inc. (the "Subcontractor"). The parties do hereby agree as follows: 1. The Subcontractor shall provide the following services: 1) Prepare a grading summary and create a list of suggested improvements; 2) Prepare the ISO Pre -survey Packet; and 3) Assist the ISO Field Representative during the ISO Survey. 2. These services shall be provided for the rates as provided in Exhibit "A". At no time shall the total contract amount exceed $36,000.00. 3. The Subcontractor agrees to adhere to all provisions of service as outlined in the Proposal for Phase I, the Proposal for Phase Ii, and the Proposal for Phase III. The Proposals are attached hereto and are incorporated into this Contract as is fully set forth herein. 4. The parties agree that the Contractor shall be responsible for project management, scheduling, and overall project oversight. 5. The Contractor shall pay the Subcontractor in accordance with Texas Government Code §2251.022. 6. This Contract may be cancelled, without penalty, by either party by providing thirty (30) days written notice to the other party. Upon cancellation, the Contractor shall pay the Subcontractor the prorated price for acceptable services performed up to the date specified in the notice of cancellation. 7. Ursuline Street Lubbock, TX 79456-0001 Dear Chief Cooper: wanted to explain these proposals with an introductory letter. The key to my services is that when I perform a grading summary (Phase 1) and provide the community a list of suggested improvements a great deal of the information required to fill out the pre -survey packet will be assimilated at that time. Therefore, when I fill out the pre -survey packet (Phase II) it is obviously less time consuming than if I had not performed the grading summary and corresponding list of suggested improvements. The same holds true for assisting the community when the ISO Field Representative visits the community and performs his field survey (Phase III). If I have filled out his pre -survey packet then I am familiar with the infrastructure of the community as it pertains to the ISO rating. This makes it less time consuming when transferring the information to the Field Representative. The total cost to the City of Lubbock to complete only the grading summary with the corresponding list of suggested improvements will not exceed $19,100, and will require one site visit. The total cost to the City of Lubbock to complete all three projects will not exceed $36,000 (this total being contingent upon completing all three phases). The total for all three projects does not include any other site visits such as City Council presentations. Three site visits will be required. The price for completing the pre -survey packet and assisting with the transfer of information to the ISO Field Representative is contingent upon the initial phase (grading summary and list of suggested improvements) being performed. Consulting Services, Inc. 02116107 Page 1 The normal process is as follows: I visit the City of Lubbock and obtain the information to accurately grade your community. However, I do not assimilate the extensive amount of support data required by ISO to document your answers. When I obtain the required information I will return to my home office and grade the City of Lubbock as though I was the Field Representative. This grading will show, to two decimal places, what Lubbock would grade with its existing infrastructure. When the grading is complete I will compile a list of suggested improvements. Each improvement will show, again to two decimal places, how much that improvement will add to the overall grading for Lubbock. After your staff analyzes these improvements and implements the ones that are economically feasible within the budget constraints of the City of Lubbock we will request an ISO survey. At that time, ISO will assign a Field Representative. Once the Field Representative is assigned, he will send you his pre -survey packet. At that time I will return to the City of Lubbock and together we will complete this packet. We also will assimilate the support data required to document the answers to this packet. I am the only person doing this type of consulting that actually knows what the Field Representative requires. The following Fire Chiefs will back up this last statement: Cleve Calagna (The Villages), Richard Lazarus, (Longview), J.D. Gardner (former Chief of Pasadena; now Chief of Killeen), J.J. Bettega (Bellaire), Harry Simms (Texarkana), Mark Kerby (Mesquite), Charles Addington, II (Wolfforth), John Johnston (Waco), Dannie Smith (Sugar Land), Lenny Perez (Brownsville), and Roberto Rivera (EI Paso). All of these Chiefs were amazed at what was and was not required. All of the above mentioned Chiefs would reinforce that this documentation would have required weeks to compile and they would still not have had what the Field Representative actually needed. After the packet is complete we will set a time for the Field Representative to visit the City of Lubbock. At a mutually convenient time we will complete the field survey.
