HomeMy WebLinkAboutResolution - 2007-R0099 - Annex 2.00 Acres - Shallowater - 03/22/2007Resolution No. 2007-80099 March 22, 2007 Item No. 6.1 RESOLUTION WHEREAS, the City of Shallowater, Texas, has requested the City of Lubbock to approve an annexation of an area if some 2.00 acres located in the City of Lubbock's extraterritorial jurisdiction into the City of Shallowater; and WHEREAS, Section 42.023 of the Local Government Code requires written consent to annexation by a municipality whose extraterritorial jurisdiction will be reduced by an annexation conducted by another municipality; and WHEREAS, the City of Lubbock does not object to said proposed annexation by the City of Shallowater; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the governing body of the City of Lubbock hereby gives its written consent to the proposed annexation of 2.00 acres at the request of the landowner by the City of Shallowater as indicated on the letter, map and metes and bounds description attached hereto as Exhibit A and made a part hereof for all purposes. There is a discrepancy in the Beginning call of the Parent Tract. The SE comer of the parent tract is called to bear N N 0' 04' 10' W, 733.96 feet from the SE comer of the NW/4 of Section 35. Based on found monuments, adjoining deeds and occupation it appears this call should be 410 feet. It also appears that the South line of the Parent Tract based on its own Deed Dimensions should be the center of the abandoned rood shown an the unrecorded plat of Loma Cumbre Estates, however the deed to the South (V. 2909, P. 260) includes all the abandoned road, and monumentation and occupation is to the North side of the road which is 410 feet North of the occupied section line. This surveyor has not traced the chain of title to determine whether the V. 2909, P. 260 should go to the center. By Deed there could be a conflict between the Parent Tract and V. 2909, P. 260. This survey was prepared without the benefit of a Title Commitment. Easements and/or Restrictions other than those shown may apply.
