TO THE COMPOSITION AND MEMBERSHIP OF THE L'UBBOCK LIBRARIES
BOARD, BY INCREASING -11-11-3 NUMBER OF MEMBERS, PROVIDING A
SAVINGS CLAUSE; AND I)ROVII)ING FOR PUBLICATION.
WHEREAS, the City Council of the City of Lubbock has deterinined that it would
be in the best interest of the citizens of the City of Lubbock to alter the membership and
composition of the Lubbock Libraries Board-, NOW THERE"FORE:
BE IT ORDAINED BYTI-IECITY COUNCIL OFTFIE CITY OF LUBBOCK:
SECTION 2. THAT Section 2-329 of the Code of Ordinances of the City of
L Lib bock, Texas, BE and is fiei,ebyaineiided to read as follows:
"Sec. 2-329. Definition,
For the Inirposes of thisat-lielc "the board" shall InCan the Lubbock Public
Library Advisory Board."
SECTION 2. THAI' Section 2-330 of the Code of Ordinances of the City of
Lubbock, Texas, BE and is hereby amended to read as follows:
"See. 2-330. Creation; appointment; terms of members.
There is hereby created and established a library board to be composed of
nine (9) members, and sticl) board shall be officially designated as the Lubbock
Libraries Board. The library dircetor shall be an ex officio member of the library
board, witliotit voting privileges, and shall act in an advisory capacity to the
board. Eight (8) members of such board shall be appointed by the City Council
and shall hold their office for a term of three (3) years. Each meniber shall be
entitled to appoint one (1) member of such board fi-oin that COLInCil member's
district. Tlic mayor shall be entitled to appoint two (2) members 01" SUCh board.
Subject to City Council approval, the ninth member of' the board shall be each
newly elected president of'the Friends of the Lubbock City-County Library."
SECTION 3, THAT Section 2-332 of the Code of' Ordinances of the City of
Lubbock, Texas, BE and is hereby amended to read as follows:
"Sec. 2-332. Chairman and secretary; record of'proceedings.
The Lubbock 11tiblic Library Advisory Board shall appoint a chairman, a
vice-chairi-nan, and, a secretary from among its members. It shall be the duty of
the chairman to preside at. all meetings of the board. The vice-chairman shall
a-,SLInlC the cluties of the chairman in his absence and perform such other duties as
are assigned by the board. The secretary shall keep a record of all the proceedings
of-* the board, which record shall, U11011 the I-CCILICA 01" the 'ity COLincil, be
delivered to it flor its inspection elncl review. (Ord. No. 8664, § 5, 9-27-84-, Ord.

SECTION 4. THAT Section 2-333 of the Code of' Ordinances of the City of
Lubbock, Texas, BE and is hereby amended to read as follows:
"Sec. 2-333. Powers and duties.
'Hie Lubbock Public Library Advisory Board is and shall constitute an
advisory board to the City Council With authority to make recommendations 'from
time to time, oil matters pertaining to the library system. (Ord. No. 8664, § 6, 9-
27-84)"
SECTION 5. ITIAT Section 2-334 of the Code of Ordinances of the City of
Lubbock, Texas, 131"'. and is hereby amended to read as follows:
"See. 2-334. Quorum.- voting,
All recommendations made by the Lubbock Public Library Advisory
Board, to the City Council shall be by the concurring vote of five (5) members of
the board- provided, however, that this provision shall not exclude a Ininority
recornillenclation which is hereby authorized to be made In writing by less than a
IllaJority of the members of'the board. A majority cif the total membership oil'tile
board shall C01IStitUtC a (11101-Urn for the transaction of all matters to be considered
by the board. (Ord. No. 9664, § 7, 9-27-84; Ord. No. 9228, § 3, 9-22-88)"
S l:'C'HON 4. THAT Section 2-335 of the Code of Ordinances of the City of
Lubbock, Texas, BI-.",, and is hereby aniended to read as follows:
"See. 2-335. Vacancies.
Upon the death, resignation, removal or expiration of the terms of office of
any members of the Lubbock Public Library Advisory Board, the city Council
shall nominate and appoint a successor as a member of the board who shall hold
his membership for (lie unexpired term of the member lie is appointed to succeed,
or for the term of three (3) years, when the appointment is made due to the
expiration of board inernber's term. (Ord. No. 8664, § 8, 9-27-84)"
Sl-"-",C'I'ION 5. THAT should a paragraph, sentence, clause, phrase of work] of this
Ordinance be declared unconstitutional or invalid for any reason, the remainder of this
Ordinance shall not be affected thereby.
SECTION 6. THAT the City Secretary is hereby authorized to cause publication
of the descriptive caption of this Ordinance as an alternative method of publication
provided by law.
AND IT IS SO ORDERED
Passed by the City Council on first reading this 17th day of September 2002.
