HomeMy WebLinkAboutResolution - 2008-R0132 - Amend LP&L Rate Structure - 04/10/2008Resolution No. 2008-RO1332 April 10, 2008 Item No. 5.32 RESOLUTION WHEREAS, Lubbock Power & Light is the municipally owned electric utility of the City of Lubbock; and WHEREAS, pursuant to Section 40.055 of the Texas Utility Code, the City Council of the City of Lubbock has exclusive jurisdiction to set all terms of access, conditions, and rates applicable to services provided by Lubbock Power & Light; and WHEREAS, pursuant to Chapter 9, Article II, Section 9-17 of the Code of Ordinances of the City of Lubbock all rates to be charged for electric service provided by Lubbock Power & Light shall be determined by the City Council of the City of Lubbock in a meeting conducted pursuant to Section 551.086 of the Texas Government Code; and WHEREAS, Section 551.086 of the Texas Government Code authorizes the City Council of the City of Lubbock, as the governing body of Lubbock Power & Light, to meet in executive session to discuss, vote and take final action on a competitive matter of Lubbock Power & Light; and WHEREAS, the City Council of the City of Lubbock has determined that the subject matter of this resolution and any and all exhibits attached hereto relate to Lubbock Power & Light's competitive activity; and WHEREAS, the City Council of the City of Lubbock implemented the current rate structure for residential, commercial, industrial and other retail customers of Lubbock Power & Light via Resolution No. 2007-R0227, as amended, the corpus of which became effective June 1, 2007; and WHEREAS, the City of Lubbock desires to amend the current rate structure by amending the Large School Service Rate (15), the Secondary General Service Rate (16) and the Large Municipal Service Rate (17); and WHEREAS, the Electric Utility Board, pursuant to the Board's duties as outlined in the Chapter 2, Article XVIII, Section 2-482 (a) of the Code of Ordinances of the City of Lubbock, has reviewed this rate amendment and recommends to the City Council that such amendment be adopted; and WHEREAS, the City Council has determined in a meeting conducted pursuant to Section 9-17 of the Code of Ordinances, City of Lubbock, Texas that the attached rate and tariff structure, along with the terms and conditions thereof, would improve the efficiency and competitiveness of the City's municipally owned electric utility; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: 1. THAT Lubbock Power & Light shall, effective April 11, 2008, amend its current rate structure according to the terms and conditions attached hereto as Exhibit "A" which are incorporated herein as though set forth fully herein. 2. THAT all terms and conditions of the rate structure of Resolution No. 2007-80227, as amended, including the general terms and conditions thereof, not specifically amended by this resolution shall remain in full force and effect until the City Council of the City of Lubbock authorizes amendment of such rate structure. Miller, Mayor LARGE SCHOOL SERVICE Rate 15 Resolution No. 2008-RO132 APPLICABLE: To all public and private school facilities supplied at secondary voltage for school purposes when all service is supplied at one point of delivery and measured through one meter, where facilities of adequate capacity and suitable voltage are adjacent to the premises to be served and whose load exceeds 10 kW of demand in any month. Not applicable to temporary, breakdown, standby, supplementary, resale or shared service, or to service for which a specific rate schedule is provided. TERRITORY: Lubbock, Texas RATE: Service Availability Charge: $15.00 per month Energy Charge: $0.004170 per kWh Summer Demand Charge: $7.69 per kW Winter Demand Charge: $6.33 per kW WINTER MONTHS: The billing months of October through May SUMMER MONTHS: The billing months of June through September DEMAND: Lubbock Power and Light will furnish at its expense the necessary metering equipment to measure the customer's kW demand for the 30 -minute period of greatest use during the month. In the absence of a demand meter, the customer's demand will be billed using the monthly kilowatt-hours and an average load factor of 41.30 percent. In no month shall the billing demand be greater than the kW value determined by dividing the kWh sales for the billing period by 80 hours. FUEL/POWER COST The charge per kilowatt-hour of the above rate shall be increased by ADJUSTMENT the applicable recovery factor per kilowatt hour as provided in the FACTOR: current Lubbock Power and Light "FUEL/POWER COST ADJUSTMENT FACTORS" as approved by the City Council of the City of Lubbock. Large School Service Rev: 08/23/2007 DISCOUNT FACTOR: The charge of the above rate may be reduced in accordance with the current Lubbock Power & Light Discount Factor as approved by the City Council of the City of Lubbock. FRANCHISE FEE The charge of the above rate may be increased (i) for competitive EQUIVALENT: purposes, by an amount no greater than the equivalent franchise fee established by the City Council of the City of Lubbock for any competing electric utility; or (ii) by an amount equal to any franchise fee obligation applicable to Lubbock Power & Light as established by the City Council of the City of Lubbock. TAX: Billings under this schedule may be increased by an amount equal to the sum of the applicable federal, state and local taxes, fees, or charges levied, assessed and/or payable by Lubbock Power & Light for utility services rendered, or on the right or privilege or rendering the service, or on any object or event incidental to the rendition of the service. POWER FACTOR: Applicable to customers on this rate schedule with a peak demand of 200 kW or greater. At all times, customer will maintain at Lubbock Power & Light's point of delivery, a power factor of not less than 90% lagging. In the event a low voltage condition due to lagging power factor exists in a degree sufficient to impair Lubbock Power & Light's service, customer shall install suitable capacitors or other equipment necessary to raise the over-all power factor at the point of delivery to a satisfactory value. Where such power factor correction equipment is used, customer shall install a relay, switch or other regulating equipment for purposes of disconnecting or controlling the power factor correction equipment in order to prevent excessive voltage conditions on Lubbock Power & Light's system. TERMS OF PAYMENT: Payment due 21 days after bill date. If the 21" day falls on a weekend or an official City of Lubbock recognized holiday, the due date will be extended until the next business day. A late charge of 5% will be added to all bills not paid by the due date. CHARACTER OF AC. 60 hertz. Single-phase or three-phase, at one available SERVICE: standard voltage.
