Inc. dated May 26, 2005 Dear Lt Caspell: Tiburon, Inc. is pleased to present the City of Lubbock with this Enhancement Proposal to move the Message Switch from the RMS server to a new message switch server to be provided by the City and to change the State connection from SNA to TCP/IP. In addition, Tiburon will install the ReformatDESIGNER on the new server. The ReformatDESIGNER has new tools that will greatly improve how Lubbock defines and constructs message reformat inquiries to the State. In order for Lubbock to utilize the ReformatDESIGNER the Message Switch must be moved to an independent server. Integrating the new ReformatDESIGNER into the Tiburon applications will enable Lubbock to tap into the message reformat tools. Lubbock accepted a previous proposal for $15,910 on September 19, 2006 to change the State Protocol from SNA to TCP/IP (EP -201969). As this Message Switch and ReformatDESIGNER proposal includes that modification, Tiburon is offering to cancel EP -201969 and provide a credit of $13,870. A portion of the work from the previous proposal has already been completed (or a full credit would be offered). Scone Description Tiburon will move the Message Switch from the RMS server to a new message switch server to be provided by the City of Lubbock. In addition, Tiburon will install the ReformatDESIGNER. The message reformat tools include: Form designer Logic designer Message format designer Price Description 1) Firm Fixed Price: $48,160 Less credit ($13,870) Total $34,290 Lt. The $3,600 will be included with the annual maintenance invoice. This amount may be subject to an annual increase not to exceed 5%. 3) This quote does not include taxes levied by any government agency for technical services. Taxes for technical services, if applicable, are the responsibility of the Client. Tiburon Responsibilities 1) Configure new MSS/Ti server. 2) Install SQL. 3) Create a new database instance. 4) Create MSS/Ti tables. 5) Copy MSS tables from RMS/Ti to MSS/Ti database. 6) Set-up database backups (and test same). 7) Configure Interdomain on MSS/Ti. 8) Configure Interdomain on RMS/Ti. 9) Set-up new CAD workstation on MSS/Ti server. 10) Set-up state interface on MSS/Ti. 1 l) Set-up MDS Comm (if required). 12) Set-up RNC interface (if required). 13) MDS — script to move NMS routing field to new MSS/Ti (done at cutover). 14) Install ReformatDESIGNER on a maximum of four (4) PCs. (Client will be trained on the installation and can then install the ReformatDESIGNER on any remaining PCs that require it.) 15) Export current production forms (RFMLs and RFMTs). 16) Provide twelve (12) hours of training on the use of the ReformatDESIGNER to four (4) students. (Training will be provided during Tiburon's regular business hours of 8:00 a.m. to 5:00 p.m. Monday through Friday.) The twelve (12) hours of training will be provided in a single trip. 17) Place the new MSS/Ti into production operation. Lt. Jon Caspell City of Lubbock Enhancement Proposal (EP) -214895B: Message Switch and ReformatDESIGNER August 9, 2007 Page 3 of 6 Client Responsibilities I ) Designate a person to be the principal point of contact for all technical questions and administrative arrangements relating to this Enhancement Proposal. 2) Provide VPN access to Tiburon development personnel. 3) Provide a new server according to Tiburon's specifications. Specifications will be provided in a separate document. 4) Enter RMS/Ti terminals into the CAD/Ti terminal table. 5) Enter ORIs and mnemonics into MS Translation Table. 6) Enter Message Groups into MSGroups table. 7) Enter new commands for messaging into CAD/Ti (precede with "Z"). 8) Change CAD terminals in DTRM to point to CADSVR. 9) Provide a facility for training with a workstation (with a connection to the Tiburon systems) for the instructor and a projection screen. 10) Provide a workstation (with a connection to the Tiburon systems) for each student in the class. 11) Schedule students to attend the training (maximum of 4 students). 12) Ensure that scheduled students are able to attend the courses for their complete duration. Completion Criteria This work will be considered complete when MSS/Ti is placed into production operation. If Client does not confirm completion with a sign off letter presented by the Tiburon project manager within ten (10) business days of submittal of such letter, or otherwise notifies Tiburon in writing why completion sign -off has not been provided any final invoice(s) will be issued and will be payable in accordance with the payment terms of this Enhancement Proposal. Terms and Conditions I ) This work will be scheduled to commence at a mutually agreeable date after Enhancement Proposal acceptance. 2) Payment Schedule: 50% Upon Tiburon receipt of the signed acceptance of the Enhancement Proposal. 0 50% Upon achievement of the Completion Criteria. Client -specific documentation is not included. 4) Hardware is not included in Enhancement Proposal. All hardware will be provided by the City of Lubbock according to the specifications contained in Attachment A. Prior to placing an order for the server, the City must run the final configuration by Tiburon for approval. 5) The terms and conditions of this Enhancement Proposal and the Agreement referenced herein prevail regardless of any conflicting or additional terms on any Purchase Order or other correspondence. Any contingencies or additional terms obtained on any Purchase Order are not binding upon Tiburon. All Purchase Orders are subject to approval and acceptance by Tiburon. 6) This fixed price Enhancement Proposal is valid unless modified by Tiburon in writing prior to Client acceptance of this Enhancement Proposal; otherwise, this Enhancement Proposal will expire on March 28, 2008. 7) By the Client's acceptance of this Enhancement Proposal in the signature blocks provided below, the Client is authorizing Tiburon to proceed with the work described herein and confirms funding will be obligated.
