HomeMy WebLinkAboutResolution - 2008-R0090 - Amendment To Contract - HDR Engineering Inc.- Storm Water Drainage Issues - 03/13/2008Resolution No. 2008-R0090 March 13, 2008 Item No, 4.19 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the City Council of the City of Lubbock hereby authorizes and directs the Mayor of the City of Lubbock to execute an Amendment 91 to a Professional Engineering Services Contract entered into August 23, 2007, by and between the City of Lubbock and HDR Engineering, Inc., of Austin, Texas, for engineering services related to storm water drainage issues in Mose Hood and Stumpy Hamilton parks, which Contract and any associated documents, are attached hereto and made a part of this Resolution for all intents and purposes. MILLER, MAYOR Resolution No. 2008-R0090 AMENDMENT 41 TO AGREEMENT BETWEEN THE CITY OF LUBBOCK, TEXAS AND HDR ENGINEERING, INC. FOR PROFESSIONAL ENGINEERING SERVICES THIS IS AN AMENDMENT TO THE AGREEMENT dated and effective as of August 23, 2007 between The City of Lubbock, Texas and HDR Engineering, Inc. OWNER and ENGINEER in consideration of their mutual covenants as set forth herein agree to modify the Agreement as follows: Revise Exhibit A, Paragraph A1.03 to read as follows: A1.03 Final Design Phase A. After acceptance by Owner of the Report and any other deliverables, selection by Owner of a recommended solution and indication of any specific modifications or changes in the scope, extent, character, or design requirements of the Project desired by Owner, and upon written authorization from Owner, Engineer shall: 1. Prepare Construction Plans: ENGINEER will prepare detailed construction drawings in accordance with City of Lubbock standards. Both Park site drainage improvements will be included in one plan set and bid as one project. Provide 50%, 90%, and "Issued for Bid" set of complete FDF copies of construction drawings for review and comment by OWNER. Upon final approval, provide electronic PDF set of "Issued for Bid" construction plan sets. Based on the current scope of the Project, the construction plans are anticipated to include the drawings listed below. (1) Cover Sheet (2) General Construction Notes Site Layout Sheets - Mose Hood & Stumpy Hamilton Parks (MHP & (3-4) SHP) - 2 Sheets (5-6) Grading, Erosion & Sedimentation Control Plan MHP & SHP - 2 Sheets (7) Erosion and Sediment Control Details - I Sheet (8-9) Storm Sewer Plan & Profile MHP - 2 Sheets (10) Storm Sewer Plan & Profile SHP - 1 Sheet (11-12) Grading and Drainage Standard Details - 2 Sheets (13-15) Special Structures/Trash Rack Details - 3 Sheets (16-17) Temporary Irrigation Plan & Details SHP - 2 Sheets (18-19) Permanent Irrigation Plan & Details MHP - 2 Sheets (prepared by City) OWNER's Responsibilities: Review 50%, 90%, and Issued for Bid set of construction plans and provide comments to ENGINEER in a timely manner. Provide permanent irrigation plan and details for Mose Hood Park to be included in construction plan set. 2. Perform "No Rise" Floodplain Analysis: ENGINEER will obtain the current effective FEMA hydrologic and hydraulic models and develop post-project models based on the final design. ENGINEER will compare the post-project base flood elevations with the current effective base flood elevations for compliance with minimum FEMA NFIP requirements and OWNER°s floodplain regulations. ENGINEER will prepare a brief technical memorandum summarizing the results of the analysis. OWNER's Responsibilities. OWNER's Floodplain Administrator will determine if a FEMA Letter of Map Change (LOMC) is required based on the results of the No Rise Floodplain Analysis. If required, ENGINEER will perform the LOMC work upon written authorization to proceed from OWNER. OWNER will be responsible for payment of associated regulatory fees. 3. Prepare and Process FEMA CLOMRILOMR: Upon OWNER's review of the No Rise Floodplain Analysis, and if deemed necessary by OWNER, ENGINEER will, upon written authorization to proceed from OWNER, prepare and process a FEMA CLOMR application based on the final design. Upon completion of construction of the project improvements, ENGINEER will prepare and process a FEMA LOMR application based on the final record drawings. ENGINEER will process the CLOMR/LOMR applications through final approval by FEMA. ENGINEER will assist the OWNER in providing standard notifications to affected property owners by determining and providing the OWNER with the affected parcels. OWNER's Responsibilities: OWNER will be responsible for payment of associated regulatory fees. OWNER's Floodplain Administrator will review and approve CLOMR and LOMR applications prepared by ENGINEER. OWNER will prepare and deliver standard notifications to property owners affected by the CLOMR/LOMR per FEMA requirements. 4. Prepare Technical Specifications: ENGINEER will prepare complete Technical Specifications for construction in accordance with TxDOT standards and applicable City of Lubbock standards, as well as Special Provisions to Technical Specifications and Special Specifications as required. Provide 90% and "Issued for Bid" PDF copy of Specifications for review and comment by the OWNER. Upon final approval, provide electronic set of Issued for Bid Specifications. OWNER's Responsibilities. Review 90% and Issued for Bid Technical Specifications and provide comments to ENGINEER in a timely manner. OWNER will prepare "Front End" bidding documents including, but not limited to, Bidding Requirements, Contract Forms, and Conditions of the Contract. OWNER will provide Technical Specifications for the permanent irrigation design for Mose Hood Park. 5. Opinion of Probable Construction Cost: ENGINEER will prepare opinion of probable Construction Cost for the Work. The opinion will be based on recent bid tabulations for similar work available to ENGINEER and/or provided by the OWNER. ENGINEER will furnish a PDF copy of cost estimate to OWNER. OWNER's Responsibilities: Furnish bid tabulations available to the OWNER (if any) for similar projects in the Lubbock area within the previous 36 months. Review the opinion and provide review comments to ENGINEER in a timely manner. OWNER will provide their cost estimate for their permanent irrigation plan design for Mose Hood Park. B. ENGINEER's services under the Final Design Phase will be considered complete on the date when the deliverables required by paragraphs A1.03.A.1-4 have been delivered to OWNER. Revise Exhibit A, Paragraph Al. 04 to read as follows: A1.04 Bidding or Negotiating Phase A. After acceptance by Owner of the Bidding Documents and the most recent opinion of probable Construction Cost as determined in the Final Design Phase, and upon written authorization by Owner to proceed, Engineer shall: 1. Assist in Advertising for Bids: Assist Owner in advertising for and obtaining bids or proposals for the Work. OWNER's Responsibilities: Maintain a record of prospective bidders to whom Bidding Documents have been issued and receive and process contractor deposits or charges for the Bidding Documents. 2. Pre -Bid Conference: ENGINEER will prepare and conduct a Pre -Bid Conference to present the project to prospective bidders, provide clarifications, and answer questions. OWNER's Responsibilities: Attend Pre -Bid Conference and provide meeting facilities. 3. Prepare Responses to RFI's: ENGINEER will prepare and issue addenda required to clarify Contractor requests for information. 4. Review Bids: ENGINEER will attend the Bid opening, prepare Bid tabulations, assist OWNER in evaluating Bids or proposals, and make recommendations to the OWNER within five (5) days of bid opening. B. The Bidding or Negotiating Phase will be considered complete upon commencement of the Construction Phase or upon cessation of negotiations with prospective contractors. Revise Exhibit C, Paragraph C4.01A to read as follows: A. OWNER shall pay ENGINEER for Basic Services set forth in Exhibit A as follows: 1. A Lump Sum amount of $111,807.00 based on the following assumed distribution of compensation: a. Field Survey $21,735.00 b. Preliminaa Design Phase $10,485.00 Original Contract Subtotal: $32,220.00 C. Final Design Phase $61,519.00 d. Bidding and Negotiating Phase $10,068.00 e. FEMA CLOMR/LOMR $8,000.00** £ Construction Phase $ TBD* Amendment #1 Subtotal: $79,587.00 *To be negotiated upon completion of the Bidding & Negotiating Phase. **Dependent on results of"No Rise" floodplain analysis, requires written authorization to proceed by OWNER. 2.4. (no change) 5. The Lump Sum is conditioned on Contract Times to complete the Work not exceeding fifteen (15) months. Should the Contract Times to complete the Work be extended beyond this period at no fault of the ENGINEER, the total compensation to ENGINEER shall be appropriately adjusted.
