WHEREAS, Section 132.007, Local Government Code, provides that the governing body
of the City of Lubbock may authorize the Municipal Court of Record to collect fines, fees, court
costs and other charges by means of internet payments with credit cards; and
WHEREAS, providing such services for convenience of the citizens will result in
unavoidable fees for such services; and
WHEREAS, the City Council of the City of Lubbock has determined that it is in the best
interest of the citizens of the City of Lubbock to provide for internet payments with credit cards
for Municipal Court fines, fees and court costs and has determined that such services by internet
are not feasible without the imposition of a charge or cost for such services; and
WHEREAS, such services may be obtained pursuant to the City's existing agreement for
computer software services with Tyler Technologies, Inc., (INCODE) of Lubbock, Texas, NOW
THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT pursuant to Section 132.007, Local Government Code, the City
Council of the City of Lubbock hereby determines that it would be in the best interest of the
citizens of the City of Lubbock to permit the payment of Municipal Court of Record fines, fees
and other costs by internet access and credit card payments.
SECTION 2. THAT as it would not be feasible to provide said access and services
without imposition of a charge for such access and services, the Municipal Court of Record may
charge users such amount as will recover the costs directly and reasonably incurred for providing
such access and services to them.
