HomeMy WebLinkAboutResolution - 2009-R0572 - Deny Application Of SPS - 12/16/2009Resolution No. 2009-R0572 December 16, 2009 Item No. 6.5 ORDER AND RESOLUTION AN ORDER AND RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LUBBOCK SITTING AS A REGULATORY AUTHORITY PURSUANT TO § 33.001 OF THE TEXAS UTILITIES CODE, WITH REGARD TO AN APPLICATION TO REVISE ITS MISCELLANEOUS SERVICE CHARGES TARIFF FILED BY SOUTHWESTERN PUBLIC SERVICE COMPANY ("SPS") WITH THE CITY. WHEREAS, pursuant to § 33.001 of the TEXAS UTILITIES CODE, the City of Lubbock has exclusive original jurisdiction over the rates, operations, and services of an electric utility operating within the corporate limits of the City of Lubbock; and WHEREAS, SPS has heretofore filed a Statement of Intent and Application to Revise its Miscellaneous Service Charges Tariff (the "Application") with the on December 4, 2009; and WHEREAS, SPS has in its Application requested a revised tariff to allow the sale of Renewable Energy Credits ("RECs") to SPS's retail customers at a mutually -agreeable price where one REC represents one megawatt -hour of renewable energy metered in Texas; and WHEREAS, only those customers who choose to purchase the RECs will be affected by the proposed revision; and NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT, pursuant to the applicable provisions of the TEXAS UTILITIES CODE and pursuant to the request made by SFS in its Application, the City Council of the City of Lubbock hereby DENIES the Application of SPS.
