RESOLUTION
WHEREAS, the current charter for the great City of Lubbock, Texas, is 92 years
old; and
WHEREAS, it has been 21 years since the charter has been substantially reviewed
and amended, and just like the United States Constitution and the State of Texas
Constitution, occasionally necessitates amendments per the citizens' desire as evidenced
by their vote; and
WHEREAS, the charter contains many antiquated provisions in need of review;
and
WHEREAS, the operation of a city of 219,000 people has more requirements than
in previous times with smaller populations and less infrastructure; and
WHEREAS, the citizens have expressed a desire to further define the financial
relationship between Lubbock Power & Light and the City; and
WHEREAS, the City Council finds it to be in the best interest of the public to
name a Charter Review Committee as set forth herein; NOW THEREFORE:
BE IT RESOLVED BY THE CITY OF LUBBOCK, TEXAS:
a) THAT a Charter Review Committee is hereby created for the purpose of
reviewing the current City charter for possible amendment and reporting
any recommendations to the City Council.
b) THAT the number of citizens serving on the Charter Review Committee
shall be seven (7), with each member of the City Council appointing one
(1) member to the committee, and the Mayor appointing the committee's
chair; and
c) THAT appointments to the committee be made and announced at the first
regularly scheduled City Council meeting in January, 2010; and
d) THAT prior to issuing a report with recommendations, the committee hold
at least two (2) public hearings on the matters before it, with at least one
(1) of said public hearings occurring in the evening; and
e) THAT a report with recommendations be made back from the committee
to the City Council in a timely fashion at the committee's discretion;
f) THAT said Charter Review Committee's review will include, but not be
limited to, the following sections of the charter:
• Article IX Section 2 Term of Office
• Article LX Section 4 Free Admission
• Article IX Section 10 City Treasurer
• Article IX Section I 1 Duties of the Mayor
• Article IX Section 24 Payments
• Article X Section 4 Powers and Duties
• Article X Section 6 Relations with the City Manager
• Article XII Section I Electric Utility Board
