Said Amendment No. 2 is attached hereto and ncorporated in this resolution as if fully set forth herein and shall be included in the .ninutes of the City Council. TOM MARTIN, MAYOR Resolution No. 2009-80467 AMENDMENT NO.2 TO AGREEMENT FOR ENGINEERING SERVICES FOR INDIANA AVE PAVING IMPROVEMENTS (103`t° ST TO FM 1585) CITY OF LUBBOCK, TEXAS AND KIMLEY-HORN AND ASSOCIATES, INC. THIS Amendment No. 2 to Agreement for Engineering Services ("Amendment No. 2"), dated effective this 5th day of November, 2009, is by and between Kimley-Horn and Associates, Inc. ("Engineer") and the City of Lubbock, Texas ("Owner"), a Texas home rule municipal corporation. WHEREAS, pursuant to Agreement for Engineering Services, dated on or about October 23, 2008, Resolution No. 2008-RO417 (the "Original Agreement"), Engineer agreed to provide engineering services to Owner consisting of the design of paving improvements on Indiana Ave. from 103`d St to FM 1585. WHEREAS, Amendment No. 1 to the Agreement for Engineering Services, dated on or about February 26, 2009, Resolution No. 2009-R0088, Engineer agreed to provide certain additional engineering services to Owner on the Indiana Ave. project. WHEREAS, Owner and Engineer now desire to amend the Original Agreement with this Amendment No. 2 as follows By adding attachment "SCOPE OF SERVICES - CONTRACT AMENDMENT #2 and attachment "ATTACHMENT C1 — WORKPLAN FOR LUMP SUM SERVICES" to this "Amendment No. 2" resulting in a Base increase of $20,100.00 for additional engineering services for the Indiana Avenue project for an amended total Lump Sum compensation of $643,800.00. By adding attachment "SCOPE OF SERVICES - CONTRACT AMENDMENT #2" and attachment "ATTACHMENT Cl — WORKPLAN FOR REIMBURSABLE SERVICES" to this "Amendment No. 2" resulting in a Base increase of $7,700,00 for additional services for the Indiana Avenue project for an amended "not -to -exceed" reimbursable fee $273,732.00. Senior Vice President I Project Manager Indiana Avenue from 103`d St. to F.M. 1585 Scope of Services - Contract Amendment #2 City of Lubbock Project Understanding The Project includes the widening of Indiana Avenue from 103'd Street to F.M. 1585 (13 Street). Street). This Amendment No. 2 includes the additional design of 116"' Street for approximately '/z mile to the half section line, modification of the span wire signal design at FM 1585 to a permanent signal„ and additional parcel descriptions for right of way acquisition along Indiana Ave. Survey Coordination (116th Street Design) 1.1. Coordinate with City designated surveyor 1.1.1 The City of Lubbock has asked Hugo -Reed to prepare additional right of way and topographic survey for 116th Street between Indiana and the 1/2 section line to the east. 1.1.2 Kimley-Horn will coordinate survey needs for the design of 116th Street with Hugo -Reed. They will also work with Hugo -Reed on the right of way and easement required for 116th roadway and channel improvements. Right -of -Way / Easement Instruments of Conveyance 2.1. Increase the number of right-of-way instruments (narrative and graphic exhibits of right-of-way takes). 2.1.1 Up to 12 additional right of way parcels are anticipated 2.1.2 Includes parcels to be converted from right of way easement to dedicated right of way 2.2. Individual parcel exhibits shall be on 8',fa"x11" paper, shall be sealed, dated, and signed by a Registered Professional Land Surveyor and shall contain the following: 2.2.1 Parcel number 2.2.2 Area required 2.2.3 Area remaining 2.24 Legal description 2.2.5 Current owner 2.2.6 Any existing platted easements or easements filed by separate instrument including easements provided by utility companies 2.2.7 All physical features 2.2.8 Metes and bounds description of parcel to be acquired. The description shall be provided on a separate sheet from the exhibit. Each type of easement shall be described separately. Preliminary Design 3.1. Project Management 3.1.1 Additional coordination with franchise utility companies. 3.1.2 Additional coordination with TOOT regarding permanent signal at FM 1585 instead of span wire signal. 3.2. Roadway and Channel 3.2.1 Data Collection • City appointed surveyor, Hugo -Reed, will provide the right of way and topographic survey information for 116th Street. 3.2.2 Prepare the preliminary roadway alignment • Prepare typical sections - existing and proposed • Typical Sections to include subgrade and pavement design specification provided by the City • Prepare preliminary plan and profile (electronic roll plot format, 1 "=50' scale). Items to be included: Plan: - Control data - Existing 1 proposed right-of-way - Existing topography - Existing pavement - Proposed centerline alignment and horizontal curve data City of Lubbock - Indiana Avenue from 103rd St. to F.M. 1585 Page 1 of 3 Scope of Services - Contract Amendment #2 Novemver 5, 2009 Proposed face of curb Proposed transition pavement tie-ins to existing pavement - Existing water line locations Existing sanitary sewer line locations Existing franchise utility locations (based upon SUE information) Profile: - Existing ground profiles at the proposed ROW lines - Proposed vertical alignment - Proposed grade line (PGL) will be located at the gutter line (flowline at the face of curb) - Superelevation data (if applicable) 3.3. Traffic 3.3.1 Traffic Signals • Modify preliminary design of span wire traffic signal installation to permanent traffic signal at F.M. 1585 and Indiana Avenue. Locate pole locations, controller cabinet assemblies, and power sources Locate conduit, ground boxes, and identify cabling requirements Identify detection system equipment requirements Identify emergency pre-emption equipment requirements - Identify pedestrian accommodations (crosswalks, ADA barrier free ramps, pedestrian signals, and push -buttons) Prepare preliminary intersection layouts and summary charts for each intersection Prepare list of applicable City and TxDOT design details and standard sheets for inclusion in the plans Prepare list of specifications 4. Final Design 4.1. Roadway and Channel 4.1.1 Incorporate the 60% review comments 4.1.2 Prepare plan / profile sheets (22"x34" plan sheets at a scale of 1"=50' horizontal, and 1"=2' vertical). The final bid documents will be 11"x17" plan sheets at a scale of 1 "=100' horizontal, and 1 "=4' vertical Include the following items in addition to those included in the preliminary design submittal: - Proposed easement locations (if any) - Proposed sidewalk locations - Proposed residential and commercial driveways - Horizontal Alignment Data - Traffic Control Phasing layouts Pavement marking layouts - Erosion control plans - Barrier free ramps Demolition plan Intersection layouts Small sign summary Standard design details - TxDOT standards 4.1.3 Develop design cross-sections • Develop on 50' station intervals • Show pavement and subgrade, right-of-way limits, side slopes, pavement cross slopes, curbs, and sidewalks • Cross-sections will not be provided in the bid documents but will be made available to prospective bidders City of Lubbock - Indiana Avenue from 103rd St. to F.M. 1585 Page 2 of 3 Scope of Services - Contract Amendment #2 Novemver 5, 2009 4.2.
