HomeMy WebLinkAboutResolution - 2009-R0452 - Contract - FDS Solutions LLC - Nurses To Administer H1N1 Vaccine - 10/20/2009Resolution No. 2009-RO452 October 20, 2009 Item No. 5.20 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock, a contract for nurses to administer H1NI vaccine at county -wide public school clinics, by and between the City of Lubbock and FDS Solutions, LLC d/b/a Advantage Medical Staffing of Lubbock, Texas, and related documents. Said contract is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. TOM MARTIN, MAYOR Resolution No. 2009-RO452 ADVAGE wedicafStaffing �f Q STAFFING CONTRACT -CITY AGREEMENT This agreement, by and between FDS Solutions, LLC doing business as Advantage Medical Staff=ing in the State of Texas (hereinafter called Advantage Medical Staffing), and City of Lubbock (hereinafter called City) this 20th day of October, 2009. The following rates will be charged per hour for services provided to the City: RN $ 43.00 LVN $ 35.00 Holidays: City agrees to pay the Holiday rate of one and one-half times the regular rate beginning with the 11pm shift on the eve of the actual holiday and end at the completion of the night (11-7, 10-6, 7p — 7a) shift on the actual holiday. The following holidays will be billed at the holiday rate: New Years Eve, New Years Day, Easter, Memorial Day, Fourth of July, Labor Day, Thanksgiving, Christmas, and Christmas Eve. Overtime: Advantage Medical Staff=ing' work week begins on Saturday, first shift and ends on Friday last shift. All work in excess of forty (40) hours per week worked by a healthcare provider in a City will be billed at time and one half the regular hourly rates. Overtime should be approved by the City. Timesheets: All timesheets signed by a representative of the City will serve as documentation of time of arrival, time of lunch break, and time of departure. Signature to said timesheet certifies that all information on the timesheet is correct. Daylight saving time: Spring billed one hour less, fall billed one hour more. Cancellations: The City may change or cancel its request for nursing healthcare providers without incurring cost, if Advantage Medical Staffing is notified at least four (4) hours prior to the start of the shift. With less than four (4) hours notice, Advantage Medical Staffing will invoice the City four (4) hours of the designated shift and classification hourly rate. If the need arises to cancel a shift prior to the scheduled end time, a (2) hour notice must be given to Advantage Medical Staffing. If (2) hours notice is not given, the City will be billed for the entire scheduled shift. Insurance: Advantage Medical Staffing shall provide Professional Liability insurance policies with minimum limits of $1,000,000 per occurrence and $3,000,000 annual aggregate. Proof of such insurance shall be furnished to the City. City agrees to follow Advantage Medical Staffing' workers compensation policies and procedures which mandate that the injured Health Care Professional undergo a drug screen and immediate medical attention or evaluation by an Emergency Room Physician. Healthcare Professional and City must immediately complete a standard first report of injury form and collect statements from any witnesses. A copy of such will be forwarded to Advantage Medical Staffing upon completion. Advantage Medical Staffing reserves the right to request further investigation. Employment: The City agrees not to actively recruit or hire any FDS Solutions healthcare provider for its per diem/float pool, or any other position for a period of 120 days after his/her last shift worked at the City. If the City decides to hire an FDS Solutions healthcare provider, the City agrees to a permanent placement fee of $3,000 for CNA's, $5,000 for LPN/LVN's and $8,000 for RN's.. All agreements must be in signed by management of both the City and the agency. Invoices: Invoices will be sent weekly. Invoices are to be paid in full within thirty (30) days of the invoice date. A charge of 2% will be added to the invoice every 30 days until paid in full. In the event of any action to collect unpaid invoices, the City shall be liable to the Agency or it's assignees for all costs of collection, attorney's fees, costs, including trial and appellate levels. General Provisions: Nothing in the agreement is intended nor shall be construed to create an employer/employee relationship between the contracting parties. The sole interest and responsibility of the parties is to ensure that the services covered by this agreement shall be performed and rendered in a competent, efficient and satisfactory manner. FDS Solutions will adhere to all applicable requirements by federal, state, Joint Commission on Accreditation of Healthcare Organizations (JCAHO) and Health Information Portability and Accountability Act (HIPAA), relating to the operation of its business. Agreement Terms: This agreement will continue for an initial term of one (1) year. Amendments to the terms and conditions of this agreement may also include the addition of other services offered by Advantage Medical Staffing. Amendments to this agreement now or in the future may be made as an attachment titled " Addendum" and will be acknowledged when dated and fully executed by authorized signatures of City and Advantage Medical Staffing. The rates are effective the date of this agreement, and subject to annual reviews. In the event of any changes, thirty (30) days written notice will be submitted. IN WITNESS WHEREOF, the undersigned parties do hereby bind themselves to the faithful performance of this contract.
