HomeMy WebLinkAboutResolution - 2009-R0284 - Amendment To Lease Agreement - Abilene Aero - Parking At LPSIA Hangar 20 - 07/28/2009Resolution No. 2049-RO284 July 28, 2009 Item No. 5.21 RESOLUTION BE 1T RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Amendment to Lease Agreement with Abilene Aero, Inc. d/b/a Lubbock Aero for the lease of an additional 8,636 square feet for Customer/Tenant parking at Hangar 20 at Lubbock Preston Smith International Airport, and all related documents. Said Agreement is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. June 29, 2009 STATE OF TEXAS § KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LUBBOCK AMENDMENT TO LEASE AGREEMENT This Agreement is entered into by the CITY OF LUBBOCK (referred to herein as "Lessor"), a Home Rule Municipality of Lubbock County, Texas, and ABILENE AERO, INC. d/b/a LUBBOCK AERO (referred to herein as "Lessee"). WITNESSETH: WHEREAS, Lessor and Lessee executed a Lease Agreement on the 8`h day of November, 2007, in which Lessee was granted the lease of Hangar 20 and associated ground area; and WHEREAS, Lessee leases 47,668.17 square feet of land and desires to lease an additional 8,636 square feet for customer/tenant parking west of Hangar 20; NOW THEREFORE, Lessor and Lessee agree to amend the following: I. Article One, 1.01 Leased Premises, is amended by adding the following sentence: "Customer/Tenant parking lot: 8,636 square feet (described in Exhibit A)" II. Article Three, 3.01 Rentals, B. Ground Rental, is amended as follows: "Land rental for 56,304.17 square feet of Leased Premises at the rate of $.1534 per square foot per year. Annual rental will be EIGHT THOUSAND SIX HUNDRED THIRTY-SEVEN AND 06/100 DOLLARS ($8,637.06) which rental shall be due and payable, in twelve, (12) equal monthly installments of SEVEN HUNDRED NINETEEN AND 751100 DOLLARS ($719.75)."
