HomeMy WebLinkAboutResolution - 2009-R0225 - Not Object To Release Right Of Way - State Of Texas - 06/11/2009Resolution No. 2009-Rfl225 June 11, 2009 Item No. 5.14 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: WHEREAS, the tract of land described in Exhibit "A" attached hereto and incorporated herein by reference is no longer needed for the use of citizens as a road; and WHEREAS, the tract of land is generally described as a 0.431 acre tract of surplus right-of-way out of existing Interstate 27 right-of-way, being originally a part of Tract 2A Soash-White Industrial Addition to the City of Lubbock, as situated in the SE/4 Section 2, Block E, Lubbock County, Texas; and WHEREAS, a release of the right-of-way would enable an abutting landowner, Prem Supply, Inc., more efficient use of the land; and WHEREAS, the Texas Department of Transportation has made this request of the City of Lubbock; NOW THEREFORE, BE IT RESOLVED that the City of Lubbock does not interpose any objection for the State of Texas to sell and release the said right-of-way to the abutting landowner.
