HomeMy WebLinkAboutResolution - 2009-R0211 - Dedicatory Certificate - Citibus Addition - 05/28/2009Resolution No. 2009-RO211 May 28, 2009 Item No. 5.17 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock, a Dedicatory Certificate in connection with the platting by said City of Tract A. Citibus Addition to the City of Lubbock, Lubbock County, Texas, and related documents. Said Dedicatory Certificate is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. Passed by the City Council this 28th day of May , 2009. ��Az TONf MARTIN, MAYOR ATTEST: Rebeccla Garza, City Secretary APPROVED AS 'TO CONTENT: Dave Booher, Right -of -Way Agent APPROV,kO AS TO FORM: Chad Weaver, Assistant City Attorney gs/Res.Dedicatory Certificate.Citibus Addn 05/12/09 Resolution No. 2009—RO211 DEDICATORY CERTIFICATE THE STATE OF TEXAS § COUNTY OF LUBBOCK § This is to certify that THE CITY OF LUBBOCK, TEXAS, a Texas Home -Rule Municipality, is the owner of a tract of land described as follows, to -wit: Lots 1-20, Block 56, and Lots 1-10 and 16-20, Block 72, Original Town of Lubbock, Lubbock County, Texas, including portions of previously dedicated streets and alleys included within and adjacent to said Blocks 56 and 72, being further described as follows: BEGINNING at an "x" cut on concrete for the original Northeast corner of Block 56, Original Town of Lubbock, Lubbock County, Texas, according to the snap, plat, and/or dedication deed thereof recorded in Volume 5, Page 386, Deed Records of Lubbock County, Texas, same being a point in the West right-of-way line of Buddy Holly Avenue; THENCE S. 00002'22" E., along the East line of said Block 56, and the West right-of-way line of said Buddy Holly Avenue, a distance of 464.97 feet to a point for the Northeast corner of Lot 15, Block 72, said Original Town of Lubbock; THENCE N. 89053'41" W., along the North line of said Lot 15, at 125.14 feet pass a 1/2" square tube found for the Northwest corner of said Lot 15, continuing for a total distance of 145.14 feet to an "x" cut on concrete in the West line of a 20 foot alley; THENCE South, along the West line of said 20 foot alley, a distance of 130.00 feet to a point in the South line of said Block 72, and the North right-of-way line of 9th Street; THENCE West, along the South line of said Block 72, and the North right-of-way line of said 9th Street, a distance of 125.00 feet to an "x" cut on concrete in the West line of said Block 72, and the East right-of-way line of Texas Avenue; THENCE North, along the West line of said Blocks 56 and 72, and the East right-of-way line of said Texas Avenue, a distance of 595.00 feet to an "`x" cut on concrete in the North line of said Block 56, and the South right-of-way line of 7th Street; THENCE S. 89°58'13 " E., along the North line of said Block 56, and the South right-of-way line of said 7th Street, a distance of 269.82 feet to the Point of Beginning; and the undersigned wishes to plat the above described property, designating streets, alleys, easements (surface and/or underground), and other public properties shown in accordance with the attached map, prepared by Brent Carroll, Registered Professional Land Surveyor No. 5410, on the A9 A( day of 2009, and approved by the Planning Commission of the City of Lubbock on the day of4.�/, 2009, and desiring to have said property platted and duly filed for record as required by law, all as shown on the attached map; NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That for and in consideration of the premises and the special benefits to the remainder of the property in the area, the undersibmed does hereby DEDICATE all the streets, alleys, easements (surface and/or underground), and other public properties shown and designated upon said map to the PUBLIC for PUBLIC USE FOREVER; and by these presents does impress the name of "TRACT A, CITIBUS ADDITION to the City of Lubbock, Lubbock County, Texas, a replat of Lots 1-20, Block 56 and Lots 1-10 and 16-20, Block 72, Original Town of Lubbock, Lubbock County, Texas, including portions of previously dedicated streets and alleys included within and adjacent to said Blocks 56 and 72" upon said property for the correct reference and description thereto by tract as indicated upon the attached map, and the undersigned does hereby adopt the name hereinabove stated and impresses the same upon said land, incorporating said map as a part of this dedication.
