RESOLUTION
WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in
Lubbock County, Texas, has determined and does hereby determine that the public needs,
safety and welfare demand and create a public necessity for the acquisition of additional
land for municipal public use and purposes, to -wit: for Glenna Goodacre Boulevard
widening project from University to Avenue Q and such other purposes as may be
necessary under Texas Tax Code §311.008(b)(2); and
WHEREAS, the City Council of said City finds it in the public interest and for
public purposes and municipal purposes to proceed with the acquisition of lands as
needed for such purposes as aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple interest to the tract of land further described
in Exhibit "A" attached hereto, be acquired for public purposes and municipal purposes
as set forth in the preamble hereof.
SECTION 2. THAT the owner of said tract, being Ronnie Byrd, BE offered
through the Right -of -Way Department of the City of Lubbock the amount of $28,371.00,
which is the amount appraised as the value and total damages for the fee simple interest,
for the use & benefit of the City of Lubbock, Texas, for the purposes herein stated; and
SECTION 3. THAT unless accepted forthwith, the City Attorney of said City of
Lubbock is hereby authorized and instructed to institute condemnation (eminent domain)
proceedings to acquire the fee simple interest.

BEGINNING at a 1/2" iron rod with cap set in the South right-of-way line of Glenna Goodacre Boulevard and the West line of
a 20 foot alley, for the original Northeast corner of said Lot 10, Block 114;
THENCE S. 00°06'30" E., along the East line of said Lot 10 and West line of said alley, a distance of 35.00 feet to a 1/2" iron
rod with cap set for the Southeast corner of this tract;
THENCE N. 45006'32" W. a distance of 14.14 feet to a "x" cut in concrete for a comer of this tract;
THENCE S. 89053'27" W. a distance of 63.76 feet to a 112" iron rod with cap set for the Southwest comer of this tract;
THENCE N. 0006'32" W., a distance of 25.00 feet to a 1/2" iron rod with cap set in the South right-of-way line of Glenna
Goodacre Boulevard, for the Northwest comer of this tract;
THENCE N. 89053'27" E., along said South right-of-way line, a distance of 73.76 feet to the Point of Beginning.
