ORDINANCE; RESERVING A UTILITY EASEMENT; DIREC"PING THE CITY
ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT" SAID

PROVIDING FOR PUBLICATION.

WHEREAS, the City Council finds that the alley hereinafter described in the body of$
this Ordinance is no longer needed for alley purposes and for public use; and it would be in the
public interest to close, vacate and abandon the same for alley purposes and for public use;
NOW TI-IEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:

SECTION 1. THAT the alley as hereinafter described shall BE and the same is hereby
closed, vacated and abandoned fbr alley purposes and for public use, such alley being more
particularly described in the attached Exhibit "A."
SECTION 2. THAT an easement is hereby reserved on the property described in
Section 1, above, and such easement is reserved and retained for utility easement purposes
with the right of ingress and egress at all times fir such purpose, and an casement is also
reserved f'or any and all existing pipelines or ether utilities within said property together with
all rights appurtenant to the: Continuation ofSUCh utilities.
SECTION 3. THAT the City Engineer is hereby authorized and directed to mark the
official maps of the City of Lubbock to rellect said abandonment and closing, showing the
number ofthis Ordinance and the date of its final passage.
SECTION 4. THAT should any section. paragraph, sentence, phrase, clause or word
ofthis Ordinance be declared unconstitutional or invalid for any reason, the remainder ofthis
Ordinance Shall not be affected thereby.
SECTION 5. -ITIAT the City Secretary of the City of Lubbock is hereby authorized
and directed to cause publication ol'the descriptive caption of this Ordinance as an alternative
method provided by law.
AND IT IS SO ORDERED.

A VARIABLE WIDTH ALLEY IN
BLOCK 5, MORNING SIDE ADDITION,
AN ADDITION TO THE CITY OF LUBBOCK,
LUBBOCK COUNTY, TEXAS
A variable -width alley, to be closed and vacated, situated in Block 5, Morning Side Addition, an addition to
the City of Lubbock, Lubbock County, Texas, according to the map, plat and/or dedimtion deed thereof
recorded In Volume 86, Page 624 of the Deed Records of Lubbock County, Texas, said proposed alley
closure originally dedicated by said plat of Morning Side Addition and alley dedimtlons recorded in Volume
335, Page 385, Volume 335, Page 383 and Volume 332, Page 190 of the Deed Records of Lubbock County,
Texas, said alley closure being further described by metes and bounds as follows:
BEGINNING at a point in the east right-of-way line of Avenue G, as dedicated with said plat of Morning
Side Addition, in the west line of Lot 10 of said Block 5, for the southwest comer of this closure, whenca
the southwest corner of said Lot 10 bears South 01 degrees 45 minutes 22 seconds West, a distance of
140.12 feet;
(1) THENCE North 01 degrees 45 minutes 22 seconds East, along the east dghlof-way fine of said Avenue
G, at a distance of 2.50 feel pass a 1/2-Inch iron rod found at the original northwest comer of said Lot 10,
continuing at a distanm of 17.50 feet pass a 1/2-Inch iron rod found at the original southwest comer of Lot
9 of said Block 5, continuing for a total distanm of 20.00 feet to a point In the north rightof-way line of said
variable -width alley, for the northwest corner of this closure;
(2) THENCE South 88 degrees 16 minutes 24 seconds East, along the north rightof-way line of said
variable -width alley, a distanm of 100.00 feet to a point In the common line of Lots 8 and 7 of said Block 5,
at a point of intersection for a corner of this alley closure;
(3) THENCE South 01 degrees 45 minutes 22 seconds West a distanm of 2.50 feet to a point at the
southwest corner of said Lot 7, at a point of intersection for a corner of this closure;
(4) THENCE South 88 degrees 16 minutes 24 seconds East, along the north right-of-way line of said
variable -width alley, a distanm of 50.00 feet to a point for the southeast comer of said Lot 7, at a point of
intersection for a comer of this closure;
(5) THENCE North 01 degrees 45 minutes 22 seconds East a distance of 2.50 feet to a point in the common
line of Lots 7 and 6 of said Block 5, at a point of intersection for a corner of this dosure;
(6) THENCE South 88 degrees 16 minutes 24 seconds East, along the north rightof--way line of said
variable -width alley, a distanm of 300.00 feet to a point In the west rightof-way line of Avenue F, as
dedicated with said plat of Morning Side Addition, in the east line of Lot 1 of said Block 5, for the northeast
corner of this closure, whenm the northeast comer of said Lot 1 bears North 01 degrees 45 minutes 22
seconds East a distanm of 140.21 feet;

(7) THENCE South 01 degrees 45 minutes 22 seconds West, along the west right-of-way line of said
Avenue F. at a distance of 2.50 feet pass the original southeast corner of said Lot 1, continuing at a distance
of 17.50 feet pass a 1/2-Inch Iron rod found at the original northeast comer of Lot 18 of said Block 5,
continuing for a total distance of 20.00 feet to a point in the east line of said Lot 18 for the southeast comer
of this closure, whence the southeast comer of said Lot 18 bears South 01 degrees 45 minutes 22 seconds
East a distance of 140.21 feet;
(8) THENCE North 88 degrees 18 minutes 24 seconds West, along the south line of said variable -width
alley, a distance of 450.00 feet to the POINT OF BEGINNING. Bearings called In this description are based
on the Texas Coordinate System, North Central Zone 4202, North American Datum of 1983. Distances
called in this description are surface distances. A plat showing this proposed closure is included on page 2
