RESOLUTION
WHEREAS, after many years of citizen interest in and efforts toward
revitalization of downtown Lubbock, the Downtown Redevelopment Commission (the
"DRC") was appointed in 2005; and
WHEREAS, the DRC raised private funding to hire a consultant team to prepare a
plan for the redevelopment of downtown Lubbock; then the consultant team gathered
information, interviewed citizens, and held public meetings to develop the Downtown
Revitalization Action Plan; and
WHEREAS, in 2008, the Downtown Revitalization Action Plan was presented to
the Council in a public meeting and later adopted by the City Council as recommended
by the Downtown Redevelopment Commission and by the Central Business District Tax
Increment Finance District Board of Directors to be used as a guideline for future
development in the downtown area; and
WHEREAS, among the goals and objectives of the Downtown Revitalization
Plan were the goals of reducing the fragmentation of blocks caused by bidirectional
alleys, working with utilities to consolidate and co -locate physical infrastructure located
in these alleys, and to create a safe and attractive pedestrian -friendly environment for the
citizens living, working, and visiting downtown Lubbock; and
WHEREAS, the Central Business District TIF has committed to pay for and
install new underground facilities, a duct system, to accommodate all overhead utilities
underground as redevelopment occurs in the downtown area; and
WHEREAS, the City of Lubbock, as a home municipality, has exclusive control
over and under the streets and alleys of the city; and
WHEREAS, in accordance with Lubbock Code of Ordinances § 8.13.148, the
City Council has determined that it is reasonably necessary for all utilities located
overhead in the streets and alleys of the downtown area to be relocated into an
underground duct system as this public improvement is installed by the City of Lubbock;
NOW THEREFORE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
1. THAT City staff shall give at least 60 days notice to those affected overhead
utilities of the time and exact areas where the poles will be removed in the
downtown area and where the City will be installing an underground duct
system for the relocation of utilities; and
2. THAT upon notification, all affected overhead utilities, including city -owned
utilities, shall within a reasonable time be relocated into the underground duct
system in the public right of way.
