TOM MARTN, MAYOR ATTEST: Rebecca Garza, City Secretary APPROVED AS TO CONTENT: Phyl Brown, Interim Community Development Director OVED AS TO FORM: P City n/ccdocs-CEAP res -amend Life Run Independent LivingCenters.I I Z. 1.8.11 Resolution No. 2011-RO176 STATE OF TEXAS CONTRACTOR OF LUBBOCK AMENDMENT TO COMPREHENSIVE ENERGY ASSISTANCE PROGRAM (LEAP) AGREEMENT BETWEEN THE CITY OF LUBBOCK AND LIFE RUN INDEPENDENT LIVING CENTERS This amendment to Agreement is entered into this 28th day of April, 2011 between the City of Lubbock, a Texas municipal corporation (hereinafter called "the City") and Life Run Independent Living Centers, a non-profit organization (hereinafter called "Contractor"). WHEREAS, the Contractor and the City have previously entered into an Agreement dated February 10, 2011 (hereinafter called "the Agreement"); and WHEREAS, the City and the Contractor hereby desire to amend said agreement. NOW THEREFORE, the City and the Contractor hereby agree to amend the Agreement as follows: 1) Paragraph II. B. 1. City agrees to provide Contractor assistance from Comprehensive Energy Assistance Program (CEAP) funds in an additional amount not to exceed $220,000 in CEAP fiends in addition to the $82,500 in CEAP funds previously granted in the agreement in return for Contractor performing the activities set forth in this Contract as consideration for said funds. 2) Paragraph 11. B. 2. 2nd paragraph. The Community Services Block Grant (CSBG) funds shall be disbursed in the amounts and at the time the funds are disbursed to the City by the State of Texas. The City is not responsible for any amounts not distributed by the State of Texas. CSBG funds shall be disbursed in the amount and at the time funds are disbursed to the City by the State of Texas. The State of Texas has made available an additional 21.11 percent of funds in addition to the 21.35 percent previously granted in the agreement. Therefore, the City shall disburse to the contractor up to 42.46 percent of the total amount of CSBG funds or $2123. 3) This amendment to the Agreement shall be effective upon execution. The Remainder of the Agreement shall remain in full force and affect except as changed herein. Executed the 28th Of April , 2011 as first written as affected as provided herein.
