HomeMy WebLinkAboutResolution - 2012-R0314 - Request Ad Hoc Committee To Study Schedule Of Stormwater Charges - 08/09/2012Resolution No. 2012—RO314 August 9, 2012 Item No. 6.3 RESOLUTION A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS, REQUESTING THAT AN AD HOC COMMITTEE BE APPOINTED TO STUDY THE SCHEDULE OF STORMWATER DRAINAGE CHARGES PRESENTLY IN EFFECT, THE SCHEDULE'S EQUITABLE APPLICATION AMONG PROPERTIES IN THE CITY, AND REPORT BACK FINDINGS AND RECOMMENDATIONS TO THE CITY COUNCIL. WHEREAS, the City Council of the City of Lubbock is authorized under Chapter 552 of the Texas Local Government Code to establish drainage charges for all benefitted properties located in the City; and WHEREAS, pursuant to said authority, the City Council has adopted a schedule of drainage charges most recently by way of Ordinance No. 2011-R00080; and WHEREAS, there has been concern expressed to members of the City Council of the City of Lubbock that the adopted schedule of drainage charges imposes grossly disparate treatment among property owners located in the City of Lubbock in that charges are based on the number of meters serving the property, irrespective of the nature of the property or other relevant factors; and WHEREAS, the City Council of the City of Lubbock previously charged the City Manager and the City of Lubbock Model Codes and Construction Advisory Board to study the City of Lubbock's storm water drainage charges by way of Resolution No. 2011-R0199; and WHEREAS, the City Council desires to appoint a committee sufficiently representative of the residents, business interests, and property owners of Lubbock whose task it shall be to continue the aforementioned study, expanding it freely by thorough, reasoned analysis to include, without limitation, modified tiers for rates and fees, and the development of multiple charge assessment scenarios for consideration by the City Council and other interested citizens to reach the most equitable cost-sharing possible; NOW, THEREFORE: IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the City Council of the City of Lubbock shall and does, by and upon passage create an ad hoc committee for the purpose of studying the schedule of storm water e charges presently in effect, and the schedule's equitable application to various ies in the City; THAT the committee shall consist of two (2) members of the City of Lubbock City 1, three (3) members of the City of Lubbock Model Codes and Construction Advisory two (2) members representative of the Lubbock large business community, and two (2) rs representative of the Lubbock small business community; THAT the committee shall promptly convene and from its membership elect a chair, and :eafter shall undertake a comprehensive and detailed analysis of the drainage charges 3ently applicable to residents, businesses, and property owners in the City of Lubbock. The imittee further shall be authorized to take, and shall take, all necessary steps to study storm er rates and fee schedules, including but not limited to an evaluation of different scenarios for assessment of said rates and fees so that equity and fairness are maximized: THAT the committee shall report back to the City Council, on or before the second meeting of the City Council in November of 2012, its findings and recommendations for AND APPROVED this 9thday of August '2012.
