HomeMy WebLinkAboutResolution - 2012-R0121 - Amendment To Contract - North & East Lubbock CDC - CDBG ARRA - 03/29/2012Resolution No. 2012-RO121 March 29, 2012 Item No. 5.21 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for and on behalf of the City of Lubbock, an Amendment to a Community Development funding Contract by and between the City of Lubbock and the North & East Lubbock Community Development Corporation for the Community Development Block Grant American Recovery and Reinvestment Act, and all related documents. Said Amendment is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the City Council. Passed by the City Council this March 29 , 2012. - ( l hA4-- TOM MARTIN, MAYOR ATTEST: Rebec a Garza, City Secretary APPROVED AS TO CONTENT: Phyl ' Brown, Interim Community Development Director APPROVED AS TO FORM: C" gs Assistant City Attorney gs amendment-CDFC-American Recovery&Reinvestment Act.res.12 2.20.12 STATE OF TEXAS Resolution No. 2012-RO121 CONTRACTOR OF LUBBOCK § DEVELOPMENT FUNDIN BE UBBOCK DEVE This amendment to Agreement is entered into this 29`h day of March, 2012 between the City of Lubbock, a Texas municipal corporation (hereinafter called "the City") and North and East Lubbock Community Development Corporation, a non-profit organization (hereinafter called "Contractor"). WHEREAS, the Contractor and the City have previously entered into an Agreement dated September 10, 2009 (hereinafter called "the Agreement"); and WHEREAS, the City and the Contractor hereby desire to amend said agreement. NOW THEREFORE, the City and the Contractor hereby agree to amend the Agreement as follows: 1) Paragraph I. C. 1. Of the Agreement is hereby amended as follows: "City agrees to provide Contractor assistance from Community Development Block Grant American Recovery and Reinvestment Act (CDBG-R) funds in an additional amount not to exceed $26,000.00 in addition to the $100,000 in CDBG-R funds previously granted in the Agreement in return for Contractor performing the activities set forth in this Contract as consideration for said funds." 2) This Amendment shall be effective on as of the date this Agreement is executed. 3) This amendment to the Agreement shall be effective upon execution. The remainder of the Agreement shall remain in full force and affect except as changed herein. ATTEST: FED.
