RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to
execute for and on behalf of the City of Lubbock a Dedication Deed in connection with certain
real property as described therein, and all related documents, to dedicate said real property as a
City of Lubbock Park, and to name said park property "Tim Cole Memorial Park." Said
Dedication Deed is attached hereto and incorporated in this Resolution as if fully set forth herein
and shall be included in the minutes of the Council.

This instrument shall certify that the City of Lubbock, a Texas Home Rule Municipality of
the County of Lubbock, State of Texas, is the sole owner of a tract of land in Lubbock, Lubbock
County, Texas, more particularly described in Exhibit "A" attached hereto and incorporated herein
for all purposes (the "Property").
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That for and in consideration of
the special benefits AND public purposes conferred to the residents of the City of Lubbock and to
the community at large, the undersigned does hereby designate and dedicate the above -
described Property as a City of Lubbock Park, and does so to the PUBLIC for PUBLIC USE
FOREVER; and further does by these presents impress the name of "Tim Cole Memorial Park"
upon the Property for the correct reference and description thereof, and does hereby adopt the
name hereinabove stated, and impress the same upon the said land as part of this dedication.
As designated and dedicated, the Property shall be subject to all rules, regulations, and
provisions set forth in the City of Lubbock Code of Ordinances, Chapter 16, "Parks and Other
Public Places," as may be amended from time to time.

Exhibit "A"
METES AND BOUNDS DESCRIPTION of a portion of the West Half of Lot 2, a portion of Lot 3
and a portion of the East Half of Lot 4, Block 5, Ellwood Place Addition to the City of Lubbock,
Lubbock County, Texas, and being a part of that tract conveyed to the City of Lubbock in Volume
1144, Page 506, Deed Records of Lubbock County, Texas, being further described as follows:
BEGINNING at a %" iron pipe found in the North line of a 15 foot alley which bears West a
distance of 25.0 feet from the original Southeast corner of Lot 4, Block 5, Ellwood Place Addition
to the City of Lubbock, Lubbock County, Texas, said iron pipe being the Southwest corner of this
tract;
THENCE North, along the West line of the East Half of Lot 4, a distance of 215.3 feet to a '/2" iron
rod with cap found in the South right-of-way line of 191h Street at the Northwest corner of this
tract;
THENCE S. 84°53' E., along the South right-of-way line of 19th Street, a distance of 2.55 feet to a
'/2" iron rod with cap set for a point of curvature;
THENCE Southeasterly around a curve to the right, said curve having a radius of 107.0 feet, a
central angle of 84°53', tangent lengths of 97.85 feet, a chord distance of 144.42 feet, and an arc
length of 158.52 feet to a '/2" iron rod with cap set for a point of tangency;
THENCE South, along the East line of the West Half of Lot 2, a distance of 108.5 feet to a'/z"iron
rod with cap set in the North line of a 15 foot alley for the Southeast corner of this tract;
THENCE West, along the North line of said alley, a distance of 100.00 feet to the Point of
Beginning, and containing 19,094 square feet,
LESS AND EXCEPT that portion of the tract subject to that certain Land Use License executed
pursuant to Lubbock City Council Resolution No. 5974, dated August 27, 1998, and further
described as follows:
BEGINNING at a point that is 25.00 feet East of the Southwest corner of Lot 4, Block 5, Ellwood
Place Addition to the City of Lubbock, Lubbock County, Texas;
THENCE East along the South lot lines of Lots 2, 3, and 4, said Ellwood Place Addition a
distance of 100.00 feet to a point;
THENCE North 30.00 feet to a point;
THENCE West along a line parallel to the South lot lines 2, 3, and 4, said Ellwood Place Addition
a distance of 100.00 feet to a point;
