Said Change Order No. 1 is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. Date: 10-7-13 BID/ITB/RFP #: ITB# 13 -11078 -CI Contract #: 11078 Project Name: Paving Improvements: Milwaukee Avenue "Change Order" means a written order to a Contractor executed by the Owner in accordance with the contract authorizing an addition to, deletion from, or adjustment or revision of the requirements of the contract documents, or an adjustment to the compensation payable to Contractor, or to the time for performance of the contract and completion of the Project, or a combination thereof, which does not alter the nature of the thing to be constructed and is an integral part of the project objective. Adjustments to "Estimated Quantities" to a line item in a Unit Price contract do not require a Change Order. All work that alters the nature of the thins to be constructed or that is not an intesral part of the project objective must be let out for public bid. Description of change (alteration, deviation, addition, or deletion) caused by conditions encountered during construction not covered by the specifications and drawings of the project (attach additional pages if necessary): Amendment #1 involves two changes to the project: 1) Adjust of an existing 12 -inch water line by lowering it to the proper depth. Although the city utility was installed to the proper depth at the time of its original construction, those standards were less than current standards. The widening of Milwaukee Avenue and the associated grade changes of the widened pavement will now leave the utility with less than the current required minimum cover, thus the water line will be lowered to achieve the appropriate cover. Cost of this adjustment is $229,771.43 which is 2.80% of the contract value. Thirty (30) days will be added to the contract to accomplish this work. 2) Adjust the plan design for roadway illumination. The plans originally called for 40 -foot tall streetlight poles to be installed along both sides of Milwaukee Avenue. However, SPEC currently maintains an overhead electric utility along the west side of Milwaukee Avenue that is too low to accommodate the placement of new light poles beneath the electric lines. This amendment eliminates the light poles from the west side of Milwaukee Avenue, and modifies the height of the poles on the east side of Milwaukee to 30 - feet. At the request of LP&L, this amendment removes the option of allowing aluminum poles, and instead requires steel poles. Cost of this adjustment is a cost savings to the contract in the amount of ($22,409.22) which is (0.27%) of the contract value. No additional time will be added to accomplish this work. Where the Change Order is negotiated, the Change Order must be fully documented and itemized as to costs, including material quantities, material costs, taxes, insurance, employee benefits, other related costs, profit and overhead. Where certain unit prices are contained in the initial contract, no deviations are allowed in computing negotiated change order costs. Item 1 - This change will adjust an existing City of Lubbock 12 -inch water line by lowering it to the proper depth. The existing 12 -inch water line is located within a utility easement adjacent to the east right of way line of Milwaukee Avenue, between 104`i' Street and 114"' Street. Although this utility was originally installed at the proper depth, those standards do not meet current depth requirements.
