HomeMy WebLinkAboutResolution - 2013-R0226 - City Council Item - 72 Hour Completed Form Submission Requirement - 07/11/2013Resolution No. 2013-RO226 July 11, 2013 Item No. 6.5 RESOLUTION WHEREAS, the City Council of the City of Lubbock, in a continuing effort to ensure transparency, open government, and good governance, previously adopted Resolution No. 2013-R0146, which requires, absent an express waiver by the City Council, all items to be considered by the body to have been presented in complete form no later than seventy-two (72) hours prior to the meeting; and WHEREAS, a question has arisen as to whether the aforementioned Resolution requires that certain information supplemental to the item to be considered by the City Council, such as financial impact statements, be likewise subject to the seventy-two (72) hour limitation; and WHEREAS, it most effectively achieves the necessary and laudable best practices of good governance to provide all anticipated costs in connection with an action item, by specific dollar amount, and where said specific amounts may not be ascertained, a maximum "not -to -exceed" cost should be presented; and WHEREAS, the City Council now desires to refine its existing statement of resolve to include matters supplemental and otherwise essential to a complete understanding of a matter before the City Council to be presented to the City Council in accordance with the principles set forth in Resolution No. 2013-R0146. said matters to include, without limitation, financial impact statements of the item and any activities precedent thereto; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT except in emergency circumstances, or where there is an urgent public necessity where a meeting of the Lubbock City Council has been called pursuant to applicable state law, or unless waived by a majority vote of the City Council, City Council shall consider no item unless it shall be presented in completed form, subject to amendment by City Council consistent with City Council policy and procedure, not later than seventy-two hours prior to the meeting at which the item is posted for consideration. This requirement shall also apply to financial impact statements prepared in connection with the underlying item, or otherwise applicable to activities precedent thereto.
