RESOLUTION
WHEREAS, the City Council of the City of Lubbock passed Resolution 2012-RO314 on
August 9, 2012, and pursuant thereto appointed an ad hoc storm water committee (the
"Committee") to study storm water rates, and report its findings and recommendations back to
the City Council; and
WHEREAS, the Committee fulfilled its charge under the aforementioned resolution, and
presented its findings and recommendations to the City Council on November 29, 2012; and
WHEREAS, the policy recommendations of the Committee included the following:
1. assessment of storm water utility charges for residential property based on
the area of impervious square footage of each property according to
placement thereof into one of four tiers as set forth below:
a. Tier 1: residences with an area not exceeding 850 square feet;
b. Tier 2: residences with an area of between 851 square feet and 1,650
square feet;
c. Tier 3: residences with an area of between 1,651 square feet and 2,450
square feet; or
d. Tier 4: residences with an area in excess of 2,451 square feet;
2. assessment of storm water utility charges for commercial property based
on the area of impervious square footage of each property, according to
placement thereof into one of four tiers, as set forth below, with a
minimum assessed charge being no less than the Tier 4 residential rate,
and a maximum assessed charge being no greater than that charge assessed
to a property having 150,000 square feet of impervious surface:
a. Tier 1: commercial properties with an area not exceeding 14,999 square
feet;
b. Tier 2: commercial properties with an area of between 15,000 square feet
and 59,999 square feet.
c. Tier 3: commercial properties with an area of between 60,000 square
feet and 149,999 square feet; or
d. Tier 4: commercial properties with an area in excess of 150,000 square
feet;
3. maintaining a revenue generation target ratio of sixty percent (60%)
derived from residential properties and forty percent (40%) derived from
commercial properties;
4. maintaining current exemptions from storm water utility charges for
property and facilities owned by public school districts, the State of Texas,
Lubbock County, and the City of Lubbock.
5. reclassifying property zoned and built as apartment -type housing as
"commercial property" for the purposes of assessing storm water charges;
and
WHEREAS, recognizing that both the City of Lubbock organization and affected
ratepayers would need sufficient lead time to plan for an implementation of the policy
recommendations, should they be accepted and adopted by the City Council, the Committee

dvised that the effective date for final implementation to be October 1, 2014; and
WHEREAS, the City Council of the City of Lubbock now desires to accept and adopt the
policy recommendations of the Committee, and accordingly desires to instruct the City Manager
and the Chief Executive Officer of Lubbock Power & Light to begin all necessary processes and
actions to effectuate those policy recommendations, including without limitation steps to begin
#napping properties in the city limits as to impervious surface area, and preparing the City of
ubbock billing system to utilize said data in the transition from water meter billing to premise-
ased billing; NOW, THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the City Council of the City of Lubbock does hereby instruct the City Manager
and the Chief Executive Officer of Lubbock Power & Light to take all necessary preliminary
actions to effectuate a transition from water meter billing to a premise -based billing system for
the City of Lubbock's storm water drainage fees, of such a type recommended by the Committee
and set forth herein, and in such a way that, upon final adoption by ordinance or other formal
action by the City Council of those recommended changes, the implementation by the City would
be promptly accomplished.
