RESOLUTION
WHEREAS, Chapter 38, Section 38.01.005(17) of the Code of Ordinances of the
City of Lubbock (Subdivision Regulations) requires City Council approval of a street
design which will include an island within the street; and
WHEREAS, the Owner/Developer of Elm Park has requested that the City
Council approve a street design that will include islands in streets within the boundaries
of this development, platted as Tracts C through K & Tracts 1-7, Elm Park an addition to
the City of Lubbock, Texas; and
WHEREAS, said islands are to remain under private ownership and will be
owned and maintained as open space area by a homeowner's association; NOW
THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT, the City Council of the City of Lubbock hereby approves the inclusion of
islands in the streets within the boundaries of Elm Park, namely located on Oakridge
Avenue and 30th Street as shown on Exhibit "A" attached hereto and incorporated herein
by reference to be owned and maintained by the Elm Park Property Owner's Association
in accordance with the request of Tigris Development, LLC, which request is attached
hereto as Exhibit "A" and made a part hereof for all intents and purposes.
THAT, as a condition of approval, if any, of islands in the streets located within
Elm Park, the Developer shall be required to present to the City Engineer the design and
construction of a street pavement structure adjacent to such islands that exceeds the
minimum standard specifications for street paving, and that design and construction
proposal must be approved by the City Engineer.

Re: Preliminary Plat Elm Park Tracts C through K & Tracts 1-7, a proposed addition to
the City of Lubbock, Lubbock County Texas, in the Southeast Quarter of Section 43,
Block AK (herein sometimes the "Preliminary Plat").
Dear Wood:
As you know, we have recently submitted the above referenced Preliminary Plat for approval (a
copy of which is attached hereto and fully incorporated herein as Exhibit A). After review by the
various department heads, it now seems the Preliminary Plat will be approved at the next P&Z
hearing. After speaking with Randy and Keith, they have advised that since the Preliminary Plat
contains certain islands (as shown and located therein on Oakridge Avenue and 30`h Street), a letter
describing our paving plans around the said islands would be appropriate. Accordingly, please let
this letter serve as our agreement with the City that if the islands are actually installed (noting the
Preliminary Plat is subject to change from time to time), the portions of the streets along Oakridge
Avenue and 30`I' Street immediately adjacent to the islands will be paved with concrete rather than
asphalt at such time the streets are dedicated to the City. It should be noted that it is our intent the
islands will be owned by an Association as Common Area within Elm Park. The islands will
contain various landscaping features such as plants, vegetation, trees, and possibly self-contained
fountains. We desire to obtain the Council's approval for the islands. Please submit the island plan
before the Council for approval. Feel free to contact us should you have any questions whatsoever.
