No. 2015-RO173 No. 6.23 28, 2015 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for and on behalf of the City of Lubbock, Contract No. 12065 for professional architectural and engineering services related to the renovations of the Citizens Tower, the new police facility, and the new public works facility, said Contract to be for a fixed fee in the amount of $2,996,820.00 for the Citizens Tower restoration and renovation as the new City Hall, a fixed fee in the amount of $1,183,912.00 for the existing City Hall building and 1607 13`s Street building restoration and renovation as the new police facility, and a fixed fee in the amount of $780,000.00 for the new public works facility, and said Contract and related documents to be by and between the City of Lubbock and Perkins+Will, of Dallas, Texas. Said Contract is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. Resolution No. 2015-RO173 PROFESSIONAL SERVICES AGREEMENT STATE OF TEXAS COUNTY OF LUBBOCK This Agreement ("Agreement'), effective as of the 14th day of May 2015, is by and between City of Lubbock, Texas ("City"), a Texas home rule municipal corporation, and Perkins + Will (" P+W'D, a Texas "Corporation". WITNESSETH WHEREAS, the City desires to obtain professional Architectural and Engineering services related to the Renovations of the Citizens Tower (Old Omni Building) located at 1208 141h Street, the New Police Facility (former City Hall) located at 1625 130' Street, and the new Public Works Facility located near 402 Municipal Drive, all in Lubbock, Texas (the "Project'); and WHEREAS, P+W has a professional staff experienced and is qualified to provide professional Architectural services related to the Project, and will provide the services, as defined below, for the price provided herein, said price stipulated by City and P+W to be a fair and reasonable price; and WHEREAS, the City desires to contract with P+W to provide professional Architectural services related to the Project and P+W desires to provide the services related to same. NOW THEREFORE, for and In consideration of the terns, covenants and conditions set forth in this Agreement, the City and P+W hereby agree as follows: ARTICLE I. TERM The term of this Agreement commences on the Effective Date and continues without interruption for a term to be determined at a later date, as set forth in the receipt of the Notice to Proceed. The term may be altered by subsequent amendments of this Agreement, with the written and authorized consent of both parties. ARTICLE II. SERVICES AND COMPENSATION P+W shall perform the services described in Exhibit A, B and C with regard to the Project and payment shall be due and payable upon receipt In accordance with work provided. Payments due P+W under this Agreement shall be electronically transferred either by ACH, or wire transfer to the bank account and In accordance with the bank instructions Identified In P+W's most recent Invoice in immediately available funds no later than the payment due date. Invoice number, project name and Contract Number shall be referenced in the bank wire reference fields or the ACH addenda Information. In the Page 1 of 13 P+W Agreement — Contract# 12065 event that such electronic funds transfer methods are not available to City, then payments due P+W under this Agreement shall be made by check and mailed to the Address identified in the remittance instructions on P+W's most recent invoice. The Remittance Advice document shall be mailed with the check to the address. ARTICLE III. TERMINATION A. Termination by the City. City may terminate this Agreement, for any reason or convenience, upon thirty (30) days prior written notice to P+W. In the event this Agreement is so terminated, the City shall only pay P+W for services actually performed by P+W up to the date P+W received notice of termination as provided herein. B. Termination and Remedies. In the event P+W breaches any term and/or provision of this Agreement the City shall be entitled to exercise any right or remedy available to it by this Agreement, at law or equity, including without limitation, termination of this Agreement and assertion of action for damages and/or Injunctive relief. The exercise of any right or remedy shall not preclude the concurrent or subsequent exercise of any other right or remedy and all other rights and remedies shall be cumulative. C. Termination by P+W. In the event that the City falls to pay P+W within thirty (30) of Issuance of a properly prepared invoice P+W shall provide the City with not less than thirty (30) days prior written notice of such breach. If the City does not remedy such breach within such notice period, then P+W has the right to terminate this Agreement and to be paid for all services rendered to the date of termination. ARTICLE IV. NON -ARBITRATION A. The City reserves the right to exercise any right or remedy available to It by law, contract equity, or otherwise, Including without limitation, the right to seek any and all forms of relief In a court of competent jurisdiction, Further, the City shall not be subject to any arbitration process prior to exercising its unrestricted right to seek judicial remedy. The remedies set forth herein are cumulative and not exclusive, and may be exercised concurrently. To the extent of any conflict between this provision and another provision In, or related to, this document, this provision shall control. ARTICLE V. REPRESENTATIONS AND WARRANTIES A. Existence. P+W Is a Corporation duly organized, validly existing, and In good standing under the laws of the State of Texas and is qualified to carry on Its business in the State of Texas. B. Authorization. Execution, delivery, and performance of this Agreement and the activities contemplated hereby have been duly and validly authorized by P+W. This Agreement constitutes legal, valid, and binding obligations of P+W and Is enforceable in accordance with the terms thereof. C. Professional. P+W maintains a professional staff and employs, as needed, other qualified specialists experienced in providing the Services, and are familiar with applicable laws, rules, and regulations, both state and federal, Including, without limitation the applicable laws, regarding the activities contemplated hereby. Page 2 of 13 P+W Agreement — Contract# 12065 D. Performance. P+W will and shall conduct all activities contemplated by this Agreement in accordance with the standard of care, skill and diligence normally provided by a professional person In performance of similar professional Architectural services, and comply with applicable laws, rules, and regulations, both state and federal, relating to professional Architectural services, as contemplated hereby. If, during the six month period following the earlier of completion or termination of the Project It Is shown there is an error In the Project caused solely by P+W's failure to meet such standards, and City has promptly notified P+W In writing of any such error within that period, P+W shall perform, at P+W's cost, such corrective Architectural services within the original Scope of Services as may be necessary to remedy such error. E. Use of Copyrighted Material. P+W warrants that any materials provided by P+W for use by City pursuant to this Agreement shall not contain any proprietary material owned by any other party that is protected under the Copyright Act or any other law, statute, rule, order, regulation or ordinance relating to the use or reproduction of materials. The City warrants that any materials provided to P+W by the City or Its agents or representatives may be Incorporated Into the work product of P+W without Infringement upon the Intellectual property rights of any third party. Excepting for the City's warranted information, above, P+W shall be solely responsible for ensuring that any materials provided by P+W pursuant to this Agreement satisfy this requirement and P+W agrees to Indemnify and hold City harmless from all liability or loss caused to City or to which City Is exposed on account of P+W's failure to perform this duty. ARTICLE VI. SCOPE OF WORK P+W shall accomplish the following: Professional Architectural and Engineering Services related to the Renovations of the Citizens Tower, New Police Facility and New Public Works Fadlity, as defined in Exhibit "A", "B" and "C". ARTICLE VII. INDEPENDENT CONSULTANT STATUS P+W and City agree that P+W shall perform the duties under this Agreement as an Independent consultant and shall be considered as Independent consultant under this Agreement and/or in Its activities hereunder for all purposes. P+W have the sole discretion to determine the manner in which the services are to be performed. During the performance of the Project under this Agreement, P+W and P+W's employees and/or sub -consultants, will not be considered, for any purpose, employees or agents of the City within the meaning or the application of any federal, state or local law or regulation, including without limitation, laws, rules or regulations regarding or related to unemployment Insurance, old age benefits, workers compensation, labor, personal Injury or taxes of any kind. ARTICLE VIII. INSURANCE P+W shall procure and carry, at its sole cost and expense through the life of this Agreement, Insurance protection as hereinafter specified, In form and substance satisfactory to City, carried with an Insurance company authorized to transact business in the state of Texas, covering damages to the extent the same are caused by the negligence of P+W or Its sub -consultants In connection with this Agreement. Page 3 of 13 P+W Agreement - Contract# 12065 P+W shall obtain and maintain in full force and effect during the term of this Agreement, and shall cause each approved subcontractor or sub -consultant of P+W to obtain and maintain in full force and effect during the term of this Agreement, commercial general liability, professional liability and automobile liability coverage for non -owned and hired vehicles with Insurance carriers authorized to do business In the state of Texas. Except for Professional liability, the policies will be written on an occurrence basis, subject to the following minimum limits of liability: Commercial General Liability: Each Occurrence: $2,000,000 General Aggregate: $2,000,000 Products/Completed Operations Agg. $2,000,000 Professional Liability: Per Claim (Tail Clause Required): Automobile Liability: Combined Single Limit for any auto: $2,000,000 per claim and In the aggregate $500,000 Per Accident P+W shall further cause any approved subcontractor or sub -consultant to procure and carry, during the term of this Agreement, Professional Liability coverage, as specified above for P+W, protecting subcontractor or sub -consultant against damages to the extent the same are caused by the professional negligence of the approved subcontractor or sub -consultant. The City shall be named as additional Insured with respect to the the Automobile liability and Commercial General Liability on a primary and The Commercial General Liability shall be on a non contributory basis and shall be granted a waiver of subrogation under those policies. P+W shall provide a Certificate of Insurance to the City as evidence of coverage. The Certificate shall provide 30 days notice of cancellation. A copy of the additional insured endorsement and waiver of subrogation attached to the policy will be included In the Certificate. Copies of all endorsements are required. P+W shall elect to obtain worker's compensation coverage pursuant to Section 406.002 of the Texas Labor Code. Further, P+W shall maintain said coverage throughout the term of this Agreement and shall comply with all provisions of Title 5 of the Texas Labor Code to ensure that P+W maintains said coverage. P+W may maintain Occupational Accident and Disability Insurance In lieu of Worker's Compensation. In either event, the policy must be endorsed to Include a waiver of subrogation in favor of the City of Lubbock. Tail Clause —Notwithstanding anything contained herein to the contrary, the professional liability policy shall be maintained, at Architect's sole cost and expense. The retroactive date shall be no later than the commencement of the performance of this contract and the discovery period (possibly through tail coverage) shall be no less than 30 years after the completion of the work specified In the contract. The provisions of this Article VIII shall survive the termination or expiration of this Agreement. If at any time during the life of the Agreement or any extension hereof, P+W falls to maintain the required Insurance in full force and effect, P+W shall be in breach hereof and all work under the Agreement shall be discontinued Immediately. EMPLOYMENT OF AGENTS/RETAINING OF CONSULTANTS P+W may employ or retain consultants, contractors, or third parries (any of which are referred to herein as "Sub-consultant'l, to perform certain duties of P+W provided that City approves the retaining of Sub -consultants (which approval shall not be unreasonably withheld). P+W is at all times responsible to City to perform the Project as provided in this Agreement and P+W is in no event relieved of any obligation under this Contract upon retainage of any approved Sub -consultant. Any agent and/or Sub -consultant retained and/or employed by P+W shall be required to carry, for the protection and benefit of the City and P+W and naming said third parties as additional Insureds, Insurance as described above in this Agreement. ARTICLE X. CONFIDENTIALITY P+W shall retain all Information received from or concerning the City and the City's business in strictest Confidence and shall not reveal such Information to third parties without prior written consent of the City, unless otherwise required by law. ARTICLE XI. INDEMNITY P+W SHALL INDEMNIFY AND SAVE HARMLESS THE CITY OF LUBBOCK AND ITS ELECTED OFFICIALS, OFFICERS, AND EMPLOYEES FROM ALL LOSSES, DAMAGES, CLAIMS, COSTS OR LIABILITY OF ANY KIND, CHARACTER, TYPE, OR DESCRIPTION, EXCLUDING CONSEQUENTIAL OR INCIDENTAL DAMAGES, BUT INCLUDING, WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, ALL EXPENSES OF LITIGATION, COURT COSTS, AND ATTORNEY'S FEES FOR INJURY OR DEATH TO ANY PERSON, OR INJURY TO ANY PROPERTY, RECEIVED OR SUSTAINED BY ANY PERSON OR PERSONS OR PROPERTY, TO THE EXTENT THE SAME ARE CAUSED BY THE NEGLIGENT ACTS OF P+W, ITS AGENTS, EMPLOYEES, AND/OR SUBCONSULTANTS, RELATED TO THE PERFORMANCE, OPERATIONS OR OMISSIONS UNDER THIS CONTRACT- AND/OR THE USE OF OCCUPATION OF CITY OWNED PROPERTY. THE INDEMNITY OBLIGATION PROVIDED HEREIN SHALL SURVIVE THE EXPIRATION OF TERMINATION OF THIS AGREEMENT. ARTICLE XII. COMPLIANCE WITH APPLICABLE LAWS P+W shall comply with applicable federal, state and local laws, statutes, ordinances, rules and regulations relating, In any way, manner or form, to the activities under this Agreement, and any amendments thereto. ARTICLE XIII. NOTICE A. General. Whenever notice from P+W to City or City to P+W is required or permitted by this Agreement and no other method of notice is provided, such notice shall be given by (1) actual delivery of the written notice to the other party by hand (in which case such notice shall be effective upon delivery); (2) facsimile (in which case such notice shall be effective upon delivery); or (3) by depositing Page 5 or 13 P+W Agreement — Contract# 12065 the written notice In the United States mall, properly addressed to the other party at the address provided In this article, registered or certified mail, return receipt requested, in which case such notice shall be effective on the third business day after such notice is so deposited. B. P+W 's Address. The address or numbers shall become effective on the 15th day after such notice Is effective. ARTICLE XIV.CITY-PROVIDED DATA City shall furnish P+W any available data in the possession of the City pertinent to P+W s Services, so long as City is entitled to rely on such data for the performance of P+W's Services under this Agreement (the "Provided Data'). P+W shall be entitled to use and rely, so long as such reliance is reasonable, upon all such Provided Data. ARTICLE XV. MISCELLANEOUS A. Captions. The captions for the articles and sections in this Agreement are inserted in this Agreement strictly for the parties' convenience In Identifying the provisions to this Agreement and shall not be given any effect in construing this Agreement. B. Audit. P+W shall provide access to Its books and records to the City. The City may audit, at Its expense and during normal business hours, P+W's books and records with respect to this Agreement between P+W and City. C. Records. P+W shall maintain records that are necessary to substantiate the services provided by P+W. D. Assignability. P+W may not assign this Agreement without the prior written approval of the City. This Agreement binds and Inures to the benefit of the City and P+W, and in the case of City, its respective sucoessors, legal representatives, and assigns, and In the case of P+W, Its permitted successors and assigns. F. Construction and Venue. THIS AGREEMENT SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS. THIS AGREEMENT IS PERFORMABLE IN LUBBOCK COUNTY, TEXAS. THE PARTIES HERETO HEREBY IRREVOCABLY CONSENT TO THE EXCLUSIVE JURISDICTION AND VENUE OF THE COURTS OF COMPETENT JURISDICTION OF THE STATE OF TEXAS, COUNTY OF LUBBOCK, FOR THE PURPOSES OF ALL LEGAL PROCEEDINGS ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE ACTIONS THAT ARE CONTEMPLATED HEREBY. G. Severability. If any provision of this Agreement is ever held to be invalid or Ineffective by any court of competent jurisdiction with respect to any person or circumstances, the remainder of this Agreement and the application of such provision to persons and/or circumstances other than those with respect to which it is held invalid or ineffective shall not be affected thereby. H. Amendment No amendment, modification, or alteration of the terms of this Agreement shall be binding unless such amendment, modification, or alteration is in writing, dated subsequent to this Agreement, and duly authorized and executed by P+W and City. I. Entire Agreement. This Contract, including Exhibits "A" and "B", attached hereto, contains the entire Agreement between the City and P+W, and there are no other written or oral promises, conditions, warranties, or representations relating to or affecting the matters contemplated herein. J. No Joint Enterprise. Nothing contained herein shall be construed to imply a joint venture, joint enterprise, partnership or principal — agent relationship between P+W and the City. K. Documents Owned by City. Any and all documents, drawings and specifications prepared by P+W as part of the Project hereunder, shall become the property of the City when P+W has been compensated as set forth in Article II, above. P+W shall make copies of any and all work products for its files. L. Notice of Waiver. A waiver by either City or P+W of a breach of this Agreement must be In writing to be effective. In the event either party shall execute and deliver such waiver, such waiver shall not affect the waiving party's rights with respect to any other or subsequent breach. M. Third Party Activities. Nothing in this Agreement shall be construed to provide any rights or benefits whatsoever to any party other than City and P+W. N. Extent of Responsibility. P+W does not guarantee that proposals, bids or actual project costs will not vary from P+W's opinions of probable cost or that actual schedules will not vary from P+W's projected schedules. P+W shall not be responsible for: (1) construction means, methods, techniques, sequences, procedures, or safety precautions and programs in connection with the Project; (2) the failure of any contractor, subcontractor, vendor, or other Project participant, not under contract to P+W, to fulfil contractual responsibilities to the Client or to comply with federal, state, or local laws, regulations, and codes; or (3) procuring permits, certificates, and licenses required for any construction unless such responsibilities are specifically assigned to P+W in Exhibit A, Scope of Services. O. Unforeseen Orcumstances. Except for Client's obligation to make payments, neither party shall be In default hereunder to the extent such default Is caused by a cause or circumstance beyond such party's reasonable control. P+W shall be entitled to an equitable adjustment in schedule and compensation in the event such circumstances occur. Page 7 of 13 P+W Agreement — Contract# 12065 P. Non -appropriation. All funds for payment by the City under this contract are subject to the availability of an annual appropriation for this purpose by the City. In the event of non -appropriation of funds by the City Council of the City of Lubbock for the goods or services provided under the contract, the City will terminate the contract, without termination charge or other liability, on the last of the then - current fiscal year or when the appropriation made for the then current year for the goods or services covered by this contract is spent, whichever event occurs first. If at any time funds are not appropriated for the continuance of this contract, cancellation shall be accepted by the Seller on thirty (30) days prior written notice, but failure to give such notice shall be of no effect and the City shall not be obligated under this contract beyond the date of termination. The Omni Office Center Restoration and Renovation as the New Lubbock City Hall: Based on the projected construction cost of $48,780,000, Perkins+Will proposes a lump sum fee of 6% of the construction cost for a total architectural and engineering fee of $2,926,820 plus reimbursable expenses per Section E estimated through CD's in the amount of $70,000. This projected cost does not account for projected cost escalation because the time of bidding for this project is yet to be determined. It is agreed that if the actual construction budget and cost are increased beyond the above amount, Perkins+Will's fees will be increased by the same percentage. BASEPROPOSALTOTAL $2,996,820 2. The Existing City Hall Building and 160713th Street Building Restoration and Renovation as the New Lubbock Police Headquarters: Based on the projected construction cost of $16,132,000, Perkins+Will proposes a lump sum fee of 6.75% of the construction cost for a total architectural and engineering fee of $1,088,912. Per our discussion, we also propose a fee of $45,000 to develop an Exterior Design Concepts Study for both the existing city hall building and the free standing two story building described in the Schematic Design scope above. If a design concept for the exterior is selected, we will provide a proposed fee for this additional scope at that time. Perkins+Will proposes a total lump sum fee of $1,133,912 for the scope of work described above plus reimbursable expenses per Section E estimated through CD's in the amount of $50,000. It is agreed that if the actual construction budget and cost are increased beyond the above amount projections, Perkins+Will's fees will be increased by the same percentage. BASE PROPOSAL TOTAL $1,183,912 New Public Works Facility at the Municipal Hill Site: As mentioned in the project description at the beginning of our proposal, our fee is based on a new ground up Public Works Facility consisting of a 25,000 SF administration building, a new warehouse of approximately 10,000 SF for storage of materials, and a new secured service yard for city service vehicles. Perkins+Will proposes a total lump sum fee of $750,000 for the scope of work described above plus reimbursable expenses per Section E estimated through CD's in the amount of $30,000. Everett Director of Facilities Management City of Lubbock 162513th St Lubbock, TX 79414 (Via e-mail) Re: New Lubbock City Hall - Omni Office Center Restoration and Renovation - Architectural and Engineering Services Proposal Dear Wes: Perkins+Will is pleased to submit the following proposal to the City of Lubbock for complete architectural and engineering services for the new proposed city hall at the existing Omni Office Center site. This proposal is based on the following project scope and is prepared based on a traditional consultant scope of services. Based on our understanding, the Architect has made the following assumptions as a basis for this proposal. PROJECT DESCRIPTION The Omni Office Center Restoration and Renovation as the New Lubbock City Hall: This project and its related structures is at 1208 14th Street in downtown Lubbock. The complex includes a series of basements and tunnels, a five -story parking garage structure, a two-story annex building and an eleven -story high rise building. The total square footage is approximately 371,5915F. A Facilities Assessment Report prepared in August, 2014 by the firm PSC was made available to our team for the purpose of this fee proposal. The assessment of the facility is the following: • Site - Repairs to the existing paving and modifications to the paving for ADA compliance. • Structural — The extensive structural repairs will be required at the roof of the tower and at the parking garage. The amount of structural repairs throughout the rest of the facility can't be determined at this time because it was not visible for inspection. • Exteriors — The entire skin which includes marble and curtain wall system will need to be replaced. • Interiors — All existing interior construction throughout all spaces will need to be removed. There is also fire damage in the basement that will need to be repaired. • Roof —The tower roof will need moderate repairs and replacement of all metal accessories. The annex roof will need to be completely replaced. • Mechanical/Electrical/Plumbing Systems — All systems need to be completely removed and replaced do to age, obsolescence, and failure to meet current codes. • Life Safety Systems —The fire alarm system and fire protection systems need to be removed and replaced and a fire sprinkler system added. Also, one of the two egress stairs is an exterior metal fire escape that will either need to be completely replaced because of rust. Accessibility (ADA) — All accessible routes from parking and into the building will have to be removed and redone because existing slopes do not meet current ADA codes. A full ADA Accessibility inspection and report will need to be conducted to determine other ADA issues. Conveying Systems (Elevators) — The existing elevators are not reliable and pose a safety hazard. Elevators need to be removed and replaced. A. SCOPE OF SERVICES Based on the Facility Assessment, a full team effort will be required by all disciplines of our team. Our scope will include: Schematic Design: • Building Assessment Verification by entire consulting team - If there are discoveries beyond that in the PSA Facility Assessment report, we will discuss and evaluate with the city prior to commencing work. • Code Analysis — A code analysis of all applicable codes and regulations will be performed in order to guide the design process. • CAD Drawing preparation — Because there are not existing digital drawings available to serve as background drawings for the design team, we will produce CAD drawings of the existing building for use throughout the entire design and construction document phase. • City Hall Visioning and Programming — Perkins+Will will develop a comprehensive vision program of all city departments, services, and spaces that will be the basis for design of the New City Hall Building. This will consist of a visioning session with city leaders in order to capture your vision for the new city hall. We will also utilize questionnaires to department leaders, on site observations and assessment of spaces in use currently at the existing city hall building and other departments throughout the city that are currently in lease space, and a series of departmental meetings. We will establish current space needs and also growth projections for each department. Also included in the Program will be desired adjacencies for optimum efficiency as well as public interaction requirements. We will conduct a presentation of the New City Hall Program to city leaders and answer question and make revisions where desirable. • Interior Schematic Design Concepts—Once we have developed the existing site and building drawings along with the program for the new city hall, we will develop a series of interior design concepts for each level of the building including, city council chamber and support areas, public lobby and interface areas with city staff, and departmental suites on each of the remaining floors. There will be a series of meetings and correspondence with your building committee in order to insure the desired outcome of the final concept. The goal of the Schematic Design Phase is to identify, quantify, locate, and size all of the building and service components. Building mechanical, electrical and structural system alternatives will be tested for cost effectiveness, operating characteristics and performance. The Architect will prepare documentation required to assist the Owner in presenting the Schematic Design concepts to jurisdictional authorities for their continuing review and approval. • Consultant Coordination — Simultaneously with the schematic design concept refinement activities, we will be working with our civil, landscape, structural, mechanical, electrical, plumbing, audio visual, information technology, and security consultants in order to support their development of the schematic design package. Each consultant will develop their work to a schematic design level that restores the Omni Center Building to a newly functional building and supports the final schematic design concept that was approved by the city. COMPENSATION For the Scope of Services described in Section A and within the scheduled durations described in Section B, Perkins+Will proposes a lump sum fee for basic Architectural services, exclusive of all reimbursable expenses, Owner's consultants' fees and costs, site related costs and Owner testing agencies. The Facility Assessment Report by PSC dated September 2014 included an Opinion of Probable Cost (OPC) to restore the building to shell space suitable for leasing including heating and cooling with minimal lighting. The OPC amount was $33,284,230. It was noted that this was the amount in 2014 and no provision was made for inflation until the date that the project will be bid. Excluded from the OPCwere, site improvements beyond repair of cracks in paving, landscape, exterior lighting, interior walls, ceilings, light fixtures, mechanical diffusers, all interior finishes, AV/IT/Security and interior millwork on each floor including enhanced public lobby and Council Chamber built in desks and seating.
