HomeMy WebLinkAboutResolution - 2015-R0160 - Modernizing Passenger Facility Charge - 05/28/2015Resolution No. 2015-R0160 Item No. 6.19 May 28, 2015 RESOLUTION NO.2015-R0160 k RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS, SUPPORTING MODERNIZATION OF THE LOCAL PASSENGER FACILITY CHARGE PROGRAM AS PART OF FEDERAL AVIATION kDMINISTRATION REAUTHORIZATION LEGISLATION BEFORE THE JNITED STATES CONGRESS. WHEREAS, The Congress of the United States of America must reauthorize the ns of the Federal Aviation Administration (FAA) prior to expiration of their Authorization on September 30, 2015; and WHEREAS, Congress will consider changes to the local Passenger Facility (PFC) program as part of Reauthorization legislation; WHEREAS, Congress in 1990 recognized that existing sources of funding for )rt development were insufficient to meet pressing local and national needs and orized local airport authorities to impose a local user charge known as the PFC ect to a federal cap to support capital improvement projects; WHEREAS, The PFC is a local airport user fee that is established locally, ;d locally, and used locally to meet critical local airport needs; WHEREAS, Procedures exist to ensure that air carriers and the public have the portunity to comment on each airport's PFC application and the proposed projects the C supports; WHEREAS, The federal PFC cap has not been adjusted since 2000 when ingress set it at $4.50, and rising construction costs have eroded the purchasing power the PFC by approximately 50 percent; WHEREAS, The City began collecting a PFC in 1993 and has collected over $37 Ilion for use in the Airport Capital Improvement Program; and WHEREAS, Direct federal funding through the FAA's Airport Improvement :)grain has declined some $150 million annually in recent years; WHEREAS, the two national airport organizations representing a majority of ports across the United States, the American Association of Airport Executives and rports Council International — North America, have requested a modernized PFC gram as part of the 2015 FAA Reauthorization process to give airports local self-help meet growing infrastructure development needs since significant additional federal ading is unlikely to materialize. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE OF LUBBOCK, TEXAS: To Support modernizing the Passenger Facility Charge to $8.50 now and indexing it for inflation to restore the original purchasing power and provide the City and other local communities the ability to set individual PFC user fees based on locally determined needs and insuring the safety and security of their airports.
