HomeMy WebLinkAboutResolution - 2016-R0292 - Bill Of Sale - Ronie Hamilton - Landfill Improvements - 08/25/2016Resolution No.2016-R0292 Item No.6.25 August 25,2016 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for and on behalfof the City of Lubbock,a Bill of Sale forthe purchase of real property improvements on the City of Lubbock Landfill site located at 5728 County Road 5800,Abernathy,Texas,by and between the City of Lubbock and Mr.Ronnie Hamilton,of Abernathy,Texas,and related documents.Said Bill of Sale is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. Passed by the City Council on August 25.2016 ATTEST: jzAs*L£^c Rebecca Garza, City Secretary, APPROVED AS TO CONTENT Scott Snider,Assistant City Manager APPROVED AS TO FORM: Just/in Pfuitt,AssistanTCity Attorney DANIEL M.POPE,MAYOR ccdocs/RFS.Bill ofSale-Ronnie Hamilton -Lubbock Landfill Structures Auaust 10.2016 Resolution No. 2016-RO292 STATE OF TEXAS COUNTY OF LUBBOCK BILL OF SALE —REAL PROPERTY IMPROVEMENTS The undersigned, RONNIE HAMILTON (the "Grantor"), for and in consideration of the sum of TEN AND NO1100 DOLLARS ($10.00) and other good and valuable consideration paid in hand to the Grantor by the City of Lubbock, Texas, a Home Rule Municipal Corporation (the "Grantee"), the receipt and sufficiency of which are hereby acknowledged, has BARGAINED, SOLD and CONVEYED and by these presents, does BARGAIN, SELL and CONVEY unto Grantee, all of Grantor's right, title, and interest to the personal property described on Exhibit "A" attached hereto and incorporated herein (the "Improvements"). THE CONVEYANCE OF THE IMPROVEMENTS IS ON A "WHERE IS", "AS IS" AND "WITH ALL FAULTS" BASIS, AND SHALL BE WITHOUT REPRESENTATION OR WARRANTY OF ANY KIND OR NATURE, WHETHER EXPRESS, STATUTORY OR IMPLIED, INCLUDING, BUT WITHOUT LIMITATION, AS TO DESCRIPTION, PHYSICAL AND ENVIRONMENTAL CONDITION OF THE IMPROVEMENTS, QUALITY, VALUE, FITNESS FOR PURPOSE, MERCHANTABILITY, OR OTHERWISE. Grantee has satisfied itself, as to the type, condition, quality and extent of the Improvements and property interests which comprise the Improvements it is receiving pursuant to this Bill of Sale. TO HAVE AND TO HOLD all of Grantor's right, title and interest in and to the Improvements unto said Grantee and Grantee's successors and assigns forever, so that neither Grantor nor Grantor's successors and assigns shall have, claim or demand any right or title to the Improvements.
