HomeMy WebLinkAboutOrdinance - 2009-O0026 - Amending Sec. 4 Of Ordinance 2009-O0018, Implementation Of Water Rates - 04/09/2009First Reading April 6, 2009 Item No. 2.1 ORDINANCE NO. 2009-00026 Second Reading April 9, 2009 Item No. 5.38 AN ORDINANCE AMENDING SECTION 4 OF ORDINANCE NO 2009- 00018 WITH REGARD TO IMPLEMENTATION OF WATER RATES WITHIN THE CITY OF LUBBOCK; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council of the City of Lubbock deems it to be in the best interest of the citizens of the City of Lubbock to revise the implementation of the new water rates established by Ordinance No. 2009-00018; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION l: THAT Section 4 of Ordinance No. 2009-00018 of the City of Lubbock, Texas is hereby amended to read as follows: "SECTION 4: THAT the effective date of implementation of the water charges and rates hereinabove set forth shall be as follows: (a) The base service charges set forth in Section I of this Ordinance (No. 2009- 00018) and amending the Code of Ordinances, City of Lubbock, Texas, at Section 28-52 such that all water utility bills or statements dated on or after May 1, 2009 shall be calculated using the base service charges set forth above. This ensures that no March 2009 water usage is calculated at the higher base charge. (b) The water volume rates provided for in Section 3 of this Ordinance (No. 2009- 00018) and amending the Code of Ordinances, City of Lubbock, Texas, at Section 28-53 such that all water utility bills or statements dated on or after May 1, 2009 shall be calculated using the water volume rates set forth above. This ensures that no March 2009 water usage is calculated at the higher volume charge. (c) To accommodate the change in implementation date from April 1 to May 1, 2009, any bills issued thus far since April 1, 2009, will be recalculated and adjusted." SECTION 2: THAT the City Council finds and declares that sufficient written notice of the date, hour, place and subject of this meeting of the Council was posted at a designated place convenient to the public at the City Hall for the time required by law preceding this meeting, that such place of posting was readily accessible at all times to the general public, and that all of the foregoing was done as required by law at all times during which this Ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents of posting hereof SECTION 3: THAT should any paragraph, section, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4: THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication provided by law.
