HomeMy WebLinkAboutResolution - 2020-R0168 - Deferred Collection LPSIA - 05/12/2020Resolution No. 2020-IZO168 Item No. 6.19 May 12, 2020 RESOLUTION NO. 2020-RO168 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS AUTHORIZING DEFERRED COLLECTION OF CERTAIN RATES, RENTALS, FEES, MINIMUM CUARANTEES, AND OTHER CHARGES INCURRED BY SIGNATORY AIRLINES, TENANTS, CONCESSIONAIRES, FIXED BASE OPERATORS, AND OTHER BUSINESSES OPERATING AT LUBBOCK PRESTON SMITH INTERNATIONAL AIRPORT WHEREAS, the City of Lubbock (City) owns and operates Lubbock Freston Smith International Airport (the "Airport"), and WHEREAS, certain signatory airlines and other businesses operate daily airline passenger -related businesses from the Airport Terminal and on Airport property under separate lease/operating agreements, and WHEREAS, restrictions due to COVID-19 have caused significant loss of airline and car rental customers and related commercial and business activity, and WHEItEAS, several signatory airlines and other businesses conducting commercial activity at the Airport have requested temporary relief from Airport rates, rentals, I'CCS, tllinin'1t1tn guarantees, and other charges, and WHEREAS, the City Council finds that it is in the best interest of the Airport and City of Lubbock, and further to protect the health,. safety, and welfare of the public, to assist eligible businesses, upon their request, by temporarily deferring for Lop to a ninety -day period the collection of certain payments otherwise due to the City/Airport, including but not limited to, those set forth in Attachment A; and WHEREAS, upon expiration of the deferral period, or July 1, 2020, whichever shall first occur, the eligible business shall remit the full delcrred balance to the City/Airport, in six equal monthly installments, in addition to remitting all current rates, charges and fte5 Lltie and payable thereafter. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS: l . That the City Manager is authorized to defer for a period of up to ninety (90) days, retroactively and tvitliout penalty or interest accruing, the collection ofcc:rtain rates, rentals, fees, minimum guarantees. and other charges under the applicable policies and lease/operating agreements for all eligible signatory airlines, tenants, concessionaires, fixed base operators, or other businesses operating at the Lubbock Preston Smith International Airport, and further having requested said deferment. 2. That upon the expiration of said deferment period, or July 1, 2020, whichever shall first occur, all amount;; for which collection was deferred shall become payable in six (6) equal monthly installments. in addition to any and all ether amounts due to the Airport/City. 3.
