(the "Engineer"), with principle offices at 4222 85'h Street, Lubbock, Texas 79423. WHEREAS, the Engineer and the Owner have previously entered into Agreement dated April 23, 2014 for professional engineering services related to the North University Streetscape Improvement Project (hereinafter called "the Agreement"); and WHEREAS, the Owner and the Engineer hereby desire to amend said agreement. NOW THEREFORE, the Owner and the Engineer hereby agree to amend the Agreement as follows: 1) THAT Article II Subsection B of the Agreement is hereby amended to read as follows: ARTICLE II. SERVICES AND COMPENSATION B. ENGINEER shall receive as consideration to be paid for the performance of the Services set forth in "Exhibit A", an amount to not exceed $106,403.00, said amount based on "Exhibit B: Basis of Fee" and "Exhibit B 1: Basis of Amended Fee", and the hourly rates, as provided in "Exhibit C". 2) THAT this Amendment to the Agreement shall be effective upon execution. The remainder of the Agreement shall remain in full force and affect except as changed herein.
