RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to
execute for and on behalf of the City of Lubbock,Supplemental Agreement No. 8 to
Agreement for the Installation and Reimbursement for Operation and Maintenance
of Traffic Signals Within Municipality between the City of Lubbock and the Texas
Department of Transportation (TxDOT),amending the scope of the underlying agreement
to provide for the addition of three (3) Diamond Interchange Signals and for the separation
from one intersection to two intersections where frontage roads of 1-27 intersect with
frontage roads of Marsha Sharp Freeway.Said Agreement is attached hereto and
incorporated in this Resolution as if fully set forth herein and shall be included in the
minutes of the Council.
Passed by the City Council this 26th day of May 2016.

SUPPLEMENTAL AGREEMENT NO.8 TO
AGREEMENT FOR THE INSTALLATION AND REIMBURSEMENT
FOR THE OPERATION AND MAINTENANCE OF TRAFFIC SIGNALS
WITHIN A MUNICIPALITY
WHEREAS,on the 11th day of August,1994,an Agreement for the Installation and
Reimbursement for the Operation and Maintenance of Traffic Signals within a Municipality
was entered into by and betweenthe Texas Department of Transportation hereinafter called
the "State,"and the City of Lubbock,hereinafter called the "City,"and subsequently identified
as the Type R Agreement by Resolution No.4559:and
WHEREAS,the parties to this agreement have mutually determined that it is necessary to
amend the original agreement due to the following reasons:addition ofthree (3)Diamond
Interchange Signals: separation from one intersection to two intersections where frontage
roads of I 27 intersect with frontage roads of Marsha Sharp Freeway.
NOW, THEREFORE,the Type R Agreementjs amended as follows:
EXHIBIT 1
EXHIBIT 1 is amended to add the traffic signal installations at the following intersections:
1)Marsha Sharp Freeway (US 82)&Milwaukee Avenue.
2)Spur 327 &Milwaukee Avenue,and
3)North Loop 289 &Erskine Avenue.
EXHIBIT 1 is amended to separate one intersection designation to two identical to other
intersecting freeway frontage roads:
4)Marsha Sharp Frontage Road (South Bound),and
5)Marsha Sharp Frontage Road (North Bound)
A copy of the revised EXHIBIT 1 is attached hereto and made a part of this agreement.

Article 4. Compensation
The maximum amount payable under this agreement is increased from
$88,780.00 to $99.160.00 per year in accordance with the above changes.
Calculations for the increase to the maximum amount payable are as follows:
AMOUNT OF THIS SUPPLEMENTAL AGREEMENT $ 10,380.00
ORIGINAL MAXIMUM AMOUNT PAYABLE PER YEAR $ 44,702.00
TOTAL PREVIOUS SUPPLEMENTAL AGREEMENTS $ 88,780.00
REVISED MAXIMUM AMOUNT PAYABLE PER YEAR $ 99,160.00
ARTICLE 5. Payment
The amount of this supplemental agreement shown above shall be a prorated amount based
on the cost for the type of installation calculated on EXHIBIT 3 of the original agreement and
any increases or decreases caused by any subsequent supplemental agreements. The
(monthly/quarterly/annual) payment shall be adjusted accordingly.
All other terms or conditions are unchanged and remain in full force and effect.
