HomeMy WebLinkAboutResolution - 2016-R0118 - Second Amendment College Baseball Hall Of Fame - 03/24/2016Resolution No.2016-RO118 Item No.6.20 March 24.2016 RESOLUTION WHEREAS the City Council,through Resolution No.2015-R0435,approved a Second Amendment to a Commitment Agreement (the "Second Amendment")between the Cityof Lubbock and the College Baseball Foundation for the construction of the College Baseball Hall of Fame;and WHEREAS the Second Amendment provided a ninety (90)day extension of the original Commitment Agreement between the Cityof Lubbock andthe College Baseball Foundation, during which time,the College Baseball Foundation was tasked with providing the City Manager with the following documentation: a) The total cost of the completed project including the museum, the event center, and the baseball field; b) A projected timeline with fund raising milestones forthe total project cost; c) Copiesof architecturaland engineering drawings for the completedproject;and d) A projected construction timeline;and WHEREAS the Second Amendment provides that an additional nine (9) month extension of the original Commitment Agreement shall be granted to the College Baseball Foundation, so that the original Commitment Agreement shall terminate on December 31,2016 by which time the Mayor of the City of Lubbock may execute a Deed Without Warranty transferring 7.86 acres located at 1502 Mac Davis Lane, in Lubbock,Texas to the College Baseball Foundation for the construction of the College Baseball Hall of Fame;and WHEREAS the ninety (90) day extension provided for in the Second Amendment shall expire on April 1,2016;and WHEREAS the College Baseball Foundation has provided the City Manager with the documentation required under the Second Amendment;NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the City Council hereby acceptsthe documentation provided by the College Baseball Foundation and so extends the term of the Commitment Agreement to December 31,2016 during which time the Mayor may execute a Deed Without Warranty transferring 7.86 acres locatedat 1502 Mac Davis Lane,in Lubbock,Texas to the College Baseball Foundation for the construction of the College Baseball Hall of Fame. Said documentation is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council.
