Resolution No. 2001-RO256 June 26, 2001 Item No. 26 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock a Spur Track Permit Agreement between the City of Lubbock and the Texas Department of Transportation to cross State Farm to Market Road 1294, and any other related documents. Said Agreement is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. Chamales Supervising Attorney/Office Practice LLC:gs/ccdocs/TXDeptofrransp.Res June 13, 2001 Resolution No. 2001—RO256 June 26, 2001 Item No. 26 Lubbock County CSJ: Project: FM Road 1294 at Interport Trade Center Spur, In Lubbock DOT No. STATE OF TEXAS § COUNTY OF TRAVIS § TEXAS DEPARTMENT OF TRANSPORTATION SPUR TRACK PERMIT AGREEMENT THIS AGREEMENT, made on the dates hereinafter shown, by and between the State of Texas, acting by and through the Texas Department of Transportation, hereinafter called the "State," and the City of Lubbock, a political subdivision of the State of Texas, hereinafter referred to as the "City." WITNESSETH WHEREAS, the State owns and maintains a system of highways, including Farm to Market Road 1294 in Lubbock County, for public use and benefit; and WHEREAS, the City desires to construct a railroad spur track to provide necessary rail access to the proposed Interport Trade Center at the Lubbock International Airport; and WHEREAS, in order to accomplish construction of the railroad spur track from the main line tracks of the Burlington Northern and Santa Fe Railway Company, it is necessary to cross FM Road 1294; and WHEREAS, the City has made application to the State for a permit to cross said highway initially with a spur track at grade and at the location shown on the print marked Exhibit "A," attached hereto and made a part hereof, and WHEREAS, it is deemed to be in the public interest that the permit for the crossing be granted by the State under certain conditions as set out in this agreement. NOW THEREFORE, in consideration of one dollar ($1.00) paid to the State by the City, receipt of which is hereby acknowledged, the State grants permission and authority for construction, maintenance, and operation of a spur track across Farm to Market Road 1294, at Highway Station No. 521+51.80 (RR Sta. 42+98.57), in Lubbock, Lubbock County, Texas, as shown on Exhibit "A" attached hereto and made a part hereof and the parties hereto mutually covenant and agree to and with each other as follows: Spur Track Permit Agreement Page 1 of 5 TRF -RR Interport Trade Center Spur 05/04/2001 AGREEMENT 1. This agreement and authority is for construction of one spur track across the highway. 2. Said spur track shall be constructed across said highway at grade at the location and in the manner shown on Exhibit "A" attached and as provided herein. 3. There is to be no general switching across the highway. 4. The City shall perform or have performed the work described herein and incident thereto. The State will not be responsible for any cost or charges in connection with this spur track crossing. All work to be done hereunder, as well as the maintenance thereof, shall be done to the satisfaction of the State. 6. Highway ditch drainage will be provided with drainage structures under the highway as shown on said Exhibit "A." 7. The City shall furnish, install and thereafter maintain a full depth solid concrete crossing pavement for the full width of the highway, including the highway shoulders, plus three feet of pavement on either side of the highway, as shown on Exhibit "A." 8. The City shall construct the spur track so that the top of the rails shall be at the same elevation as that of the surface of the roadway. There shall be no superelevation within the limits of the crown of the roadway other than to make the rails conform to the grade of the roadway pavement. 9. The City shall construct the roadway approaches on each side of the crossing as shown on said Exhibit "A" to the satisfaction of the State. 10. The City shall furnish, install and thereafter maintain standard railroad crossing crossbuck signs during the interim period between installation of the spur track crossing and actual commencement of train operations across the highway, as shown on said Exhibit "A." Prior to commencement of train operations across the highway the City shall furnish, install and thereafter maintain flashing light signals with bells and gate arms as shown on said Exhibit "A" to the satisfaction of the State. 11. The City shall install pavement markings and stop lines as directed by the State and in accordance with the Texas Manual on Uniform Traffic Control Devices. 12. The City shall install Railroad Advance Warning signs as directed by the State and in accordance with the Texas Manual on Uniform Traffic Control Devices as shown on Exhibit "A." 13. The State will thereafter maintain said pavement markings, stop lines and advance warning signs. Spur Track Permit Agreement Page 2 of 5 TRF -RR Interport Trade Center Spur 05/04/2001 14. If the State elects to modify the present highway as to its width and/or grade and/or alignment or make any other changes in the highway which will affect the grade crossing, then the State shall have the right to make such modifications and City will make adjustments of the spur track, grade crossing, highway ditch, drainage structures, crossing pavement and flashing light signals promptly and without expense to the State to make them conform to the modified highway location or design. If the highway is modified and additional drainage structures, crossing pavements and/or flashing light signals are needed, the City shall, at its expense, install and maintain said additional items to the satisfaction of the State. 15. In the construction and operation of the spur track upon and across the highway the City agrees to use reasonable care and/or require its contractor to use reasonable care to protect the traveling public. The State does not assume any liability for suits, claims or damage of whatever kind or nature arising out of or incident to the construction, maintenance, and operation of said spur track. 16. The City shall be responsible to the State for the proper maintenance of the crossing pavement as installed hereunder. 17. It is understood and agreed that if this work, or any part thereof, is performed by the State, City shall promptly reimburse the State upon presentation of an itemized bill for the work performed and materials furnished. 18. City shall not revise, change, alter or add to the crossing installation after it has been accepted by the State except with written approval of the State. This shall be further construed to mean that City's maintenance crew shall not erect obstacles, posts, or barriers around the signal bases. 19. In accordance with Title 43, Texas Administrative Code, Part I, §25.75 (formerly codified under Title 43, TAC §7.61.), and any other state laws or regulations, the City agrees that in the future, if a grade separation is necessary based on increased vehicular traffic volumes, increased train movements, auto -train involved crashes, traffic delays, safety of the traveling public or other pertinent considerations, upon written request by the State will either: a. assume responsibility for the entire expense and construction of suitable highway -rail grade separation, including right-of-way and approaches; or b. abandon this permit and remove the spur track and facilities from the highway right-of-way. 20. Should the State require construction of a highway -rail grade separation as specified in Article 19, above, and should City decline the cost of a grade separation, then the State reserves the right to cancel this permit and require .City to remove the spur track and facilities from the highway right-of- way. 21. If and when City shall abandon said spur track crossing of the highway at grade or cease operations thereover, City shall, at its expense, promptly remove from said highway and highway right-of-way the spur track and other facilities as proved herein and will replace and rebuild the highway pavement, as removed for the construction of the spur track, to the same design existing at the time of the removal of said track and to the satisfaction of the State. It is understood and agreed that any engineering, inspection, labor, material, right-of-way, or other cost borne by the State in connection with this spur crossing shall be promptly reimbursed by the City upon presentation of an itemized bill. 23. Obligations and/or rights specified under terms of this permit may not be assigned to others without the prior written approval of the State, provided, however, no approval of the State will be required for assignment of City's obligations and/or rights to a third party solely for the purpose of providing security for funding construction costs associated with construction of City's rail spur line.
