AN ORDINANCE AMENDING THE FY 2008-09 BUDGET FOR MUNICIPAL
PURPOSES RESPECTING THE CAPITAL PROGRAM TO ESTABLISH A NEW
PROJECT FOR THE CONSTRUCTION OF A 32 FOOT WIDE ASPHALT STREET
WITH CURB AND GUTTER ON EAST 16TH STREET FROM IDALOU ROAD TO
CHERRY AVENUE (A) TO ESTABLISH A NEW PROJECT FOR THE
CONSTRUCTION OF NORTH ELM AVENUE TO PROVIDE ACCESS TO A NEW
DEPARTMENT OF PUBLIC SAFETY REGIONAL HEADQUARTERS TO BE
LOCATED IN THE LUBBOCK BUSINESS PARK; RESPECTING THE GRANT
FUND TO ACCEPT AND APPROPRIATE GRANT FUNDING FROM THE TEXAS
DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS FOR THE
SOUTHWESTERN PUBLIC SERVICE LOW-INCOME PROGRAM; AND
APPROPRIATING FUNDING FROM THE HOTEL MOTEL TAX FUND BALANCE
FOR TOURNAMENTS.
WHEREAS, Section 102.010 of the Local Government Code of the State of
Texas authorizes the City Council to make changes in the budget for municipal purposes;
and
WHEREAS, in accordance with the City Budget Ordinance the City. Council shall
approve all transfers between funds and departments; and
WHEREAS, the City Council deems it advisable to change the FY 2008-09
Budget for municipal purposes as follows; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the City Council of the City of Lubbock hereby approves
changes to the City of Lubbock Budget FY 2008-09 (Budget Amendment #7) for
municipal purposes, as follows:
I. Establish a Capital Project and transfer $162,585 from General Capital
Project Fund Balance and appropriate an additional $335,815 for the
construction of a 32 foot wide asphalt street with curb and gutter on East
16`h Street from Idalou Road to Cherry Avenue for a total project
appropriation of $498,400. The funding sources are: FY 2005 Gateway
Fund Certificate of Obligations, $335,815 and General Capital Project
Fund Balance, $162,585.
II. Establish a Capital Improvement Project and appropriate $791,200 for the
construction of North Elm Avenue to provide access to the new
Department of Public Safety Regional Headquarters to be located in the
Lubbock Business Park. The project will be funded from FY 2005
Certificates of Obligation.
III. Accept and appropriate $28,164 from the Texas Department of Housing
and Community Affairs for the Southwestern Public Service Low -Income
Program.
IV. Appropriate $105,000 from the Hotel Motel Tax Fund Balance for
tournaments sponsored by the Lubbock Sports Authority.
SECTION 2. THAT a copy of the changes made to the City of Lubbock Budget
pursuant to this Ordinance shall be filed with the City Secretary and County Clerk of
Lubbock as required by law.
SECTION 3. THAT should any section, paragraph, sentence, clause, phrase or
word of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall be affected thereby.
