HomeMy WebLinkAboutResolution - 2008-R0211 - Interlocal Agreement - TTU - 06/13/2008Resolution No. 2008—RO211 June 13, 2008 Item No. 5.17 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the City Council of the City of Lubbock hereby authorizes and directs the Mayor of the City of Lubbock to execute an interlocal Agreement by and between the City of Lubbock and Texas Tech University System to create a mechanism for coping with health emergencies when either party alone has insufficient resources to meet the requirements of the emergency situation, which Agreement and any associated documents, are attached hereto and made a part of this Resolution for all intents and purposes. CONTENT: — 40A&"t't'� , Le nn Dumbauld, City Manager APPROVED AS TO FORM: r9 andiver, DDres/Tech-CityHealth EmergCon08 Res June 3, 2008 TOM MARTIN, MAYOR OGC - 05/27/08 Resolution No. 2008-RO211 STATE OF TEXAS § INTERLOCAL COOPERATION AGREEMENT COUNTY OF LUBBOCK § THIS INTERLOCAL AGREEMENT ("Agreement") is made and entered into pursuant to the Interlocal Cooperation Act (Chapter 791, Government Code) by and between the City of LUBBOCK, TEXAS hereinafter referred to as "CITY' and TEXAS TECH UNIVERSITY SYSTEM, hereinafter referred to as "TTUS." WHEREAS, TTUS is a political subdivision of the State of Texas operating under the general laws of the State of Texas; and CITY is a home rule municipal corporation operating under the charter of the municipality; and WHEREAS, CITY and TTUS mutually desire to cooperate in coping with emergencies when the parties are unable to provide the necessary resources, and; NOW THEREFORE, the following agreement is entered by and between CITY and TTUS: 1. PURPOSE. The purpose of this agreement is to create a mechanism for cooperation in coping with emergencies when TTUS or either of its Lubbock component institutions (Texas Tech University "TTU" and Texas Tech University Health Sciences Center "TTUHSC") are unable to provide the necessary resources or when the CITY is unable to provide the necessary resources. 2. TERM. The term of this agreement is for a period of five (5) years commencing on the date of execution of the Agreement, subject to earlier termination as provided in paragraph 5. This Agreement may be extended for five (5) successive terms of five (5) years each upon written agreement of all parties. 3. CITY RESPONSIBILITIES. CITY will work closely with TTUS in revising the basic emergency plan and completing the annexes to ensure that each of the specific roles and responsibilities described below can effectively be carried out in the event of an emergency: a. CITY will provide radiological protection, fire safety, hazardous materials/oil spills, and search and rescue services for the TTUS component campuses within the jurisdiction of the CITY. b. CITY will work with TTUS and its Lubbock components in developing plans for a Joint Information Center. INTERLOCAL AGREEMENT - LUBBOCK / RALLS OGC - 05/27/08 C. At the request of the TTUS Chancellor or the TTU or TTUHSC Presidents, the City of Lubbock Executive Policy Group agrees to provide assistance to the TTUS Emergency Management Executive Policy Group. d. The Lubbock Police Department will conduct joint training and exercises with the TTU Police Department. e. CITY will work with TTUS in developing a system to provide geographic information system files to Lubbock Police and Fire Departments in an effort to improve the speed and accuracy of multi -agency and/or multi- discipline responses. f. CITY will work with TTUS in providing services for the State of Texas Sheltering Hub located in Lubbock, Texas. g. CITY will work with TTUS in developing and establishing a TTUS Closed Point of Dispensing (POD) as described in the Memorandum of Agreement for Closed Point of Dispensing (POD) Sites dated May 22, 2008. 4. TTUS RESPONSIBILITIES. TTUS will work closely with CITY in revising TTUS's basic emergency plan and completing the annexes to ensure that each of the specific roles and responsibilities described below can effectively be carried out in the event of an emergency: a. TTUS will work with CITY in developing plans for a Joint Information Center. b. At the request of the Mayor of the CITY, the TTUS Emergency Executive Policy Group agrees to provide assistance to the City of Lubbock Emergency Management Executive Policy Group. C. The TTUS Police Department will conduct joint training and exercises with the Lubbock Police Department. d. TTUS will work with CITY in developing a system to provide geographic information system files to Lubbock Police and Fire Departments in an effort to improve the speed and accuracy of multi -agency and/or multi- discipline responses. e. TTUS will seek input from CITY emergency management personnel and administration in TTUS emergency management planning efforts. f. TTUS will work with CITY in providing services for the State of Texas Sheltering Hub located in Lubbock, Texas. g. TTUS will work with CITY in developing and establishing a TTUS Closed Point of Dispensing (POD) as described in the Memorandum of Agreement for Closed Point of Dispensing (POD) Sites dated May 22, 2008. 5. TERMINATION. Either party may terminate this agreement upon thirty (30) days written notice to the other.
