RESOLUTION
WHEREAS, the City of Lubbock is required to obtain certain permits from the
State of Texas regarding appropriative water rights, authorization for the reuse of its
wastewater, the transportation of biosolids and the discharge and disposal of wastewater;
and
WHEREAS, the City of Lubbock is required to execute applications and to submit
reports for all or some of such permits; and
WHEREAS, by Resolution dated September 4, 2003, Resolution No. 2003-RO362
(the "Prior Resolution"), the City Council of the City of Lubbock delegated certain
authority to the Director of Public Works; and
WHEREAS, the Prior Resolution was repealed by Resolution dated December 15,
2005, Resolution Number 2005-RO573 (the "Second Prior Resolution"); and
WHEREAS, pursuant to the Second Prior Resolution, the City Council of the City
of Lubbock delegated certain authority to the Director of Water Utilities, the Wastewater
Treatment Plant Superintendent, Chief Operator of the Wastewater Treatment Plant, the
Water Utilities Chief Operations Officer and Sampling and Monitoring Supervisor; and
WHEREAS, the City Council of the City of Lubbock now desires to repeal the
Second Prior Resolution and appoint the persons and positions to act in the capacities set
forth below, regarding said permit applications and submission of various reports
regarding such permits.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT Resolution No. 2005-RO573 is hereby repealed in its entirety and replaced
with this Resolution.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF
LUBBOCK:
THAT the Director of Water Utilities is hereby appointed by the City Council of
the City of Lubbock to execute and submit any and all applications for appropriative
water rights permits, water reuse authorizations and/or applications to amend or renew
same and any and all other related documents to be submitted to the Texas Commission
of Environmental Quality related to or in connection with Chapter 11 of the Texas Water
Code and/or other laws of the State of Texas relating to same, as each of same may be
amended from time to time, and all rules and regulations promulgated pursuant to such
laws.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF
LUBBOCK:
THAT the Director of Water Utilities is hereby appointed by the City Council of
the City of Lubbock to execute and submit discharge monitoring reports and any and all
other reports required to be submitted pursuant to Texas Permit Discharge Elimination
System Permit No. 10353-002.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF
LUBBOCK:
THAT the Director of Water Utilities is hereby appointed by the City Council of
the City of Lubbock to execute and submit discharge monitoring reports and any and all
other reports required to be submitted pursuant to Texas Permit Discharge Elimination
System Permit No. 04599.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF
LUBBOCK:
THAT the Director of Water Utilities is hereby appointed by the City Council of
the City of Lubbock to execute and submit annual sludge summaries and any and all other
reports required to be submitted pursuant to the TCEQ Transporter Registration No.
22042.
